<br />in conformity ith the approved final development plan and with all <br />other applicab e ordinances and regulations. <br /> 17.28.220 Enforcement of Development Schedule and Plan <br /> A. From t'me to time the Planning Commission shall compare <br />the actual dev lopment accomplished in the various planned unit develop- <br />ments previous approved with the development schedule and the <br />development pl n of the project. If the owner or owners of the <br />property in Planned Unit Development have failed to meet the <br />approved devel pment schedule, or development plan and any supplement- <br />ary agreements the City Council, the Planning Commission, or the <br />City Staff may initiate proceedings to review the previously approved <br />finaldevelopm Said review shall occur in the same manner <br />as review of t e final development plan in section 17.28.190, and <br />upon such revi w, the Planned Unit Development Plan may be revoked <br />or the limits f the development schedule may be extended. <br /> B. The ci y Council may require adequate assurance, in a <br />form and manne which it approves, that the common open space shown in <br />the final deve opment plan will be provided and developed. <br /> Section 3. Section l7.36.0l0, 17.36.060, l7.36.0]0, 17.36.090 <br />of the Louisvi le Municipal Code are hereby repealed. <br /> Section 4. The following sections shall be added to Chapter <br />l7.36 of Title l7 of the Louisville Municipal Code: <br /> 17.36.010 Continuation of Nonconforming Use or Structure <br /> Subject o the provisions of this chapter, a nonconforming <br />structure be continued and maintained in reasonable repair <br />but shall not e structurally altered, extended or expanded. The <br />extension nonconforming use to a portion of a structure which was <br />arranged or de igned for the nonconforming use at the time of adoption <br />of the ordinan e codified in this chapter is not an extension of a <br />nonconforming see A complete record of the location, value, nature <br />and extent of II nonconforming uses shall be maintained by the City. <br /> Destruction of a Nonconforming Use <br /> A. If nconforming structure or a structure containing a <br />nonconforming se 1S destroyed or damaged by fire, flood, wind, explosion, <br />act of God or in another manner to an extent such that the cost to <br />repair ceed 50% of the replacement cost at the time of the <br />destruction or damage, a future structure or use on the property must <br />conform to the provisions of this Code. <br /> -7- <br />
