Paul Wood, Planning Director, stated that on August 3, 1999 City Council approved <br />Resolution No. 41, Series 1999 authorizing a Final PUD and Replat for Lots 2-6, Block <br />7, The Business Center at CTC Subdivision. A condition of Resolution No. 41, Series <br />1999 required the applicant to make formal application for a text amendment to <br />Ordinance No. 501, Series 1976 which removes the geologic hazard area designated in <br />1976 prior to the issuance of a grading or building permit for Building 'A'. That area was <br />designated as such because of the possibility of mine subsidence. <br /> <br />The Planning Commission held a public hearing on August 10, 1999, and approved a <br />motion to forward Resolution No. 38, Series 1999 with a condition that the applicant <br />provide further evidence supporting the complete removal of the geologic hazard <br />designation and that no restrictions are required within Outlot 'A'. The resolution was <br />passed by a vote of 5 to 0. Scott, Cox and Associates has submitted an additional follow- <br />up letter to further clarify that no restrictions were documented within the 'removal area' <br />and that building development, parking lots, and landscaping areas are appropriate land <br />uses. <br /> <br />Davidson opened the public hearing and called for anyone wishing to speak on Ordinance <br />No. 1309, Series 1999 - An Ordinance Amending Ordinance No. 501, Series 1976, to <br />Eliminate the Geologic Hazard Area Designation for Outlot A of Lot 5, Block 7, the <br />Business Center at C.T.C. <br /> <br />NONE <br /> <br />Davidson closed the public hearing and called for Council questions and comments. <br /> <br />Mayer moved that Council approve Ordinance No. 1309, Series 1999 - An Ordinance <br />Amending Ordinance No. 501, Series 1976, to Eliminate the Geologic Hazard Area <br />Designation for Outlot A of Lot 5, Block 7, the Business Center at C.T.C, seconded by <br />Levihn. <br /> <br />Roll call was taken.
