RESOLUTION NO. 40 SERIES 2004 A RESOLUTION SETTING A BALLOT TITLE FOR PROPOSED INITIATED AMENDMENTS TO THE LOUISVILLE: HOME RULE CHARTER AND AUTHORIZING CERTAIN OTHER ACTIONS IN CONNECTION WITH A SPECIAL ELECTION ON SUCH AMENDMENTS TO BE HELD ON NOVEMBER 2,2004 WHEREAS, the City Clerk on June: 1,2004 received a statement of intent and a proposed petition section for an initiative proposing amendments to the Louisville Home Rule Charter; and WHEREAS, the initiative petition was filed with the City Clerk on August 2, 2004; and WHEREAS, on August 17, 2004 the City Clerk, acting pursuant to C.RS. Section 31-2- 210(3), certified to the City Council that the initiative petition has a sufficient number of valid signatures; and WHEREAS, the City Council is required by C.RS. Section 31-2-210(3), to set a ballot title for the proposed initiated amendments; and WHEREAS, the petition requests that the proposed initiated amendments be submitted to the registered electors of the City at a special election held on the same date as the November 2004 general election; and WHEREAS, C.RS. Section 31-2--210(4) requires that a special election on proposed initiated charter amendments be held as near as possible to the approximate date stated in the petition, and a November 2, 2004 special election on the proposed initiated charter amendments otherwise complies with applicable statutory time limits; and WHEREAS, the Boulder County Clerk and Recorder will conduct a general election on November 2, 2004, as a coordinated election pursuant to the Uniform Election Code and, in particular, C.RS. Section 1-7-116; and WHEREAS, pursuant to C.RS. Sections 1-7-116 and 31-2-210(4), the City Council has authorized that the required special election on the proposed initiated charter amendments be held as part ofthe November 2,2004 coordinated election and has provided notice ofthe proposed election aI1d proposed amendments by publication; and WHEREAS, the City Council by this resolution intends to set the ballot title for the proposed initiated amendments to the Louisville Home Rule Charter and authorize certain other actions in connection with the conduct of the special election on such amendments.
