"Defaced ftrearm" means any firearm the manufacturer's <br /> serial number of which, or other distinguishing number or identifi- <br /> cation mark of which, has been removed, defaced, altered, or des- <br /> troyed. <br /> D. The term "owner" includes the owner of any legal or <br /> equitable interest in such personal property. <br /> 9.90.020 Delivery of Lost or Found Property. <br /> Any personal property found, recovered, or confiscated by <br /> the Police Department or any other department of the City of <br /> Louisville, or found and turned in by any other person, shall be <br /> delivered to the custodian of property. <br /> 9.90.030 Custodian of Property. <br /> The Chief of Police shall appoint an employee of the <br /> Police Department to act as custodian of all property seized or <br /> taken by the Police or otherwise deposited to his care and provide <br /> a suitable place or places for the safekeeping of such property. <br /> The custodian of property shall make a reasonable attempt to tdenti- <br /> fy and locate the owners of the property in his custody. <br /> SI. 90. 040 Records. <br /> It shall be the duty of the custodian of property to keep <br /> a record of the receipt and disposition of all property coming into <br /> his custody, to include a permanent inventory of all such property, <br /> recording the date and place of the finding or recovery, serial <br /> numbers, a description of the property, and the date and method <br /> of disposal of the property to include the name and address of all <br /> claimants. <br /> 9.90.050 Delivery to Owner. <br /> When any lost, abandoned, or stolen property committed to <br /> the custody of the custodian of property, illegal weapons or contra- <br /> band excluded, is claimed by any person, it shall be the duty of <br /> the custodian of property, after demanding and obtaining satisfactory <br /> proof of ownership, to release the property to the apparent owner. <br /> Property required as evidence by the Police Department may be re- <br /> tained as long as so needed. <br /> 9.90.060 Escheat. <br /> If no claimant establishes a right to any abandoned <br /> personal property within sixty days (60) from the date when such <br /> property comes into the custody of the custodian of property, then <br /> such property shall escheat to the City of Louisville and shall be <br /> disposed of or destroyed by the custodian of property as follows: <br /> (a) All illegal weapons, pistols and hand- <br /> guns and all property the possession of which is <br /> illegal by virtue of Statute of the State of <br /> Colorado or of the United States, shall be des- <br /> troyed or turned over to the appropriate authority. <br /> (b) All money shall be delivered to the <br /> City Treasurer and deposited in the general fund <br /> of the City of Louisville. <br /> (c) All other abandoned personal property <br /> shall be disposed of by public sale. <br /> -2- <br />
