Does the Applicant demonstrate financial and technical capabilities to complete the proposed system in a timely manner; C. Are the plans submitted by the Applicant technically adequate; and, D. Does the application and the proposed system comply fully with the terms of this Ordinance? 5.20.070 Ordinance Sections All special ordinances granting authority to operate a CATV system within the City shall include the following: (a) requirement for construction commencement; (b) construction and technical standards; ( c) operation and maintenance standards; (d) condition on street occupancy; (e) signal quality requirements; (f) safety requirements; (g) City rights relative to operation; (h) forfeiture provisions; (i) duration clause; (j) revenues payable to the City; (k) security and surety provisions; (1) liability and indemnification; and (m) any other sections which the City Council may deem necessary. 5.20.080 Operational Agreement Upon the passage by City Council of a special ordinance granting an applicant authority to operate a CATV system within the City, but prior to commencement of any installation by a licensee, the licensee shall execu1:e an agreement specifically ratifying the terms required by Section 5.20.070: A. The City Council may upon failure of the Licensee to sign the required operational agreement \vithin 15 days after the effective date of the special ordinance, immediately repeal said special ordinance and Licensee shall have no further rights to install or operate a CATV system within the City.
