"" <br /> ~ <br /> (e) "Licensee" is any person who has been <br /> granted the authority to operate a CATV <br /> system with the City pursuant to this <br /> Chapter. <br /> 5.20.030 License required <br /> No person shall install, operate, or maintain a cable <br />television system within all or any portion of the City without <br />first obtaining a license therefor from City Council. <br /> 5.20.040 Application Process <br /> Any Applicant to the City must provide a specific written <br />proposal to the City Administrator which details such matters as: <br />system design: technical standards; number of channels: types of <br />specific programming being offered; construction schedules; sub- <br />scriber costs; and other matters as required by the City Administrator. <br />This specific proposal must provide for, but must not be limited to, <br />stand-by power provisions, emergency override provisions, manner of <br />testing of the system, proposed service to schools and public build- <br />ings, and complete financial statements of the Applicant. The <br />Applicant shall supply twelve copies of the written proposal and <br />said written proposal shall become part of any written agreement <br />entered into with the City. <br /> 5.20.050 Application and Transfer Fees <br /> The following fees shall be paid to the City upon the <br />filing of a new application or of an application for transfer of an <br />existing License: <br /> (a) The sum of $1,000.00 for a new application. <br /> (b) The sum of $500.00 for a transfer or <br /> assignment of an existing license. <br /> 5.20.060 City Council Action <br /> Upon receipt of the specific proposal from the Applicant, <br />City Council shall determine after review of the proposal, whether <br />a non-exclusive revocab1E~ privilege and license shall be granted to <br />the Applicant to construct, erect, operate and maintain, a CATV <br />system in the City. Said authority shall be granted by special <br />Ordinance passed by the City Council.
