<br /> B. Any other public official or employee who has an <br />interest in any proposed official action of the City shall disclose <br />as a matter of the public record of the proceedings, the nature and <br />extent of such interest. The public board, committee, or commission <br />shall decide if it desires the official or employee to participate <br />in the discussion on the proposed official action. <br /> 2.80.050 <br /> provisions of this Chapter shall be enforced as follows: <br /> A. The City Prosecuting Attorney shall have the primary <br />responsibility for the enforcement of this Code. He shall have the <br />power to investigate any complaint and to prosecute any criminal or <br />civil action on behalf of the City. <br /> B. Any person who believes that a violation of any portion <br />of this chapter has occurred and wishes to initiate proceedings on <br />such an alleged violation shall file a written and signed complaint <br />with the City Council. <br /> C. The Mayor sha.ll direct the City Prosecuting Attorney to <br />investigate or prosecute any apparent violation of this chapter. <br />Should any alleged violati.on involve a member of the City Councilor <br />the City Attorney, the Mayor shall determine if any grounds exist <br />for such allegations to warrant the appointment of a qualified <br />attorney outside the City Prosecuting Attorney's staff to investigate <br />or prosecute any alleged violation. Should the alleged violation in- <br />volve the Mayor, City Council shall determine if any grounds exist <br />as to such allegations to warrant the appointment of a qualified <br />attorney outside the City Prosecuting Attorney's staff to investigate <br />or prosecute any alleged violation. <br /> D. In the event that either the Mayor or the City Council <br />refuses to act in good faith in appointing a special prosecutor for <br />alleged violations under this chapter, or the Prosecuting Attorney <br />refuses or fails to act in good faith in investigating or prosecuting <br />an alleged violation under this chapter, the complaintant may <br />institute the appropriate civil action in the District Court of <br />Boulder County, seeking an Order for a special prosecutor. In the <br />event the District Court determines that either the City officials <br />or the complaintant acted in "bad faith" relative to such civil <br />action, the Court in its discretion may award court costs and reason- <br />able attorney's fees to the prevailing party. <br /> 2.80.060 Advisory Opinions <br /> In the event any public officer or employee is uncertain <br />as to the applicability olE any provisions of this Chapter to a parti- <br />cular situation, or as to the definition of terms used herein, he may <br />apply to the City Prosecu1ting Attorney for an advisory opinion. An <br />officer or employee shall have the opportunity to present his inter- <br />pretation of the facts at issue and of the applicability of provisions <br />of this Chapter before such advisory opinion is made. All advisory <br />opinions shall be: <br /> A. Binding upon the City, the City Council, and the Ci ty <br />Attorney and any subsequent actions concerning the public officer or <br />employee who sought the opinion and acted on it in good faith, unless <br />material facts were admitted or mis-stated in their request for the <br />advisory opinion; <br /> B. Be open to the public and shall be publicly posted; <br /> C. If the opinion concludes that the public officer or <br /> -4- <br />
