<br />ORDINANCE NO. 1459 <br />SERIES 2004 <br /> <br />AN ORDINANCE AMENDING CERTAIN SECTIONS OF CHAPTER 3.12 OF THE <br />LOUISVILLE MUNICIPAL CODE, CONCERNING TAX RELIEF FOR THE <br />ELDERLY <br /> <br />WHEREAS, pursuant Ordinance No. 430, Series 1973, the City previously established a <br />program to provide tax relief for the elderly; and <br /> <br />WHEREAS, such program consist of a rebate to qualifying persons of a designated <br />portion of the ad valorem property taxes levied by the City and actually paid on the dwelling <br />owned or rented by such person; and <br /> <br />WHEREAS, as stated in Ordinance No. 430, Series 1973, this program provides the <br />elderly relief from the financial burdens of inflation and taxation based on their respective <br />property tax contributions to the City's general revenue: and <br /> <br />WHEREAS, the City Council finds it is necessary and appropriate to amend Chapter <br />3.12 to confirm that the tax relief program therein does not extend to the City's debt service mill <br />levies, and to set a cap on the amount that may be rebated under such program. <br /> <br />NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Section 3.12.060 of the Louisville Municipal Code is hereby amended to <br />read (words added are underlined; words deleted are stricken through): <br /> <br />Sec. 3.12.060 Computation of amounts payable. <br /> <br />A. If an applicant has met all the requirements contained m this <br />chapter, the city shall pay to him the following amount: <br /> <br />1A. If the applicant lived in a dwelling owned by him or his spouse, or <br />jointly with his spouse, during any portion of the calendar year <br />preceding the year in which the application is submitted, the city <br />shall pay to him an amount equal to that portion of the total ad <br />valorem taxes which the applicant or his spouse has actually paid <br />on such dwelling unit which was levied by the city: provided, <br />however, that no payment shall exceed that amount realized by <br />levy of the city's property tax mill levy upon $250,000 of actual <br />valuation. <br /> <br />2B. If the applicant or his spouse rented a dwelling unit, or a portion <br />thereof, in which he lived during the calendar year preceding the <br />year in which the application is submitted, the city shall pay to him <br /> <br />1 <br />
