<br />ORDINANCE NO. 1450 <br />SERIES 2004 <br /> <br />AN ORDINANCE OF THE CITY OF LOUISVILLE ESTABLISHING A <br />TEMPORARY' MORATORIUM ON THE PROCESSING OF <br />APPLICATIONS FOR APPROVAL OF REZONINGS, SPECIAL REVIEW <br />USES, AND PCZD GENERAL DEVELOPMENT PLAN AMENDMENTS <br />FOR NEW RESIDENTIAL DEVELOPMENT LOCATED WITHIN THE <br />CITY, AND CREATING CERTAIN EXEMPTIONS FROM THE <br />MORATORIUM. <br /> <br />WHEREAS, the City of Louisville is a home mle municipal corporation organized under <br />and pursuant to Article XX of the Colorado Constitution and the Louisville Home Rule Charter; <br />and <br /> <br />WHEREAS, by virtue of such authority, and as further authorized by state statutes, <br />including but not limited to c.R.S. ~~ 29-20-101 et seq. and 31-23-301 et seq., the City has broad <br />authority to plan for and regulate the use and development of land on the basis of impact thereof on <br />the community and surrounding areas; and <br /> <br />WHEREAS, pursuant to such authorities, the City has established zoning districts and zone <br />district ordinances and regulations for land within the City to, among other things, promote the <br />general welfare ofthe inhabitants of the City; and <br /> <br />WHEREAS, pursuant to such authorities, the City has also adopted a Citywide <br />Comprehensive Plan, which Plan was last updated on a Citywide basis in 1989 and which Plan <br />serves as a guiding document containing the policy framework under which new development <br />and redevelopment within the City will be evaluated; and <br /> <br />WHEREAS, the City Council on April 20, 2004 formally initiated a process to review <br />and update the City's Comprehensive Plan, which process will consist of several phases and will <br />include various workshops, meetings and hearings regarding the drafting and potential adoption <br />of an updated Citywide Comprehensive Plan; and <br /> <br />WHEREAS, it is currently anticipated that the process to review and update the Citywide <br />Comprehensive Plan will take approximately one year, until March 2005; and <br /> <br />WHEREAS, one of the critical issues anticipated for evaluation as part of the <br />Comprehensive Plan review is the question of additional residential development within the City, <br />including analysis of appropriate locations for additional residential development, the impacts of <br />residential development, and the policies under which such development might occur; and <br /> <br />WHEREAS, in light of the pending review of the Citywide Comprehensive Plan, City <br />Council finds that it is appropriate to impose a temporary moratorium on the processing of <br /> <br />1 <br />
