applications for rezonings, special review uses, and Planned Community Zone District (PCZD) general development plan amendments for new residential development; and WHEREAS, the City Council finds that such a moratorium will permit the City an appropriate amount of time to undertake its Comprehensive Plan review; will foster sound land use planning and governmental decision making; and will not affect the development of properties which are currently permitted by right to pursue residential development upon compliance with all other City ordinances, mles, regulations, policies and design guidelines; and WHEREAS, the City Council has provided notice by publication of a public hearing on the temporary moratorium as set forth in this ordinance, and held a public hearing as provided in said notice. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The foregoing recitals are hereby affirmed and incorporated herein by this reference as findings of the City Council. Section 2. Upon the effective date of this ordinance, and until March 31, 2005, no application for approval of a rezoning, a special review use, or a Planned Community Zone District (PCZD) general development plan amendment for new residential development or use shall be reviewed, processed, approved, issued, or otherwise acted upon for any property within the City of Louisville. Section 3. The restrictions contained in this ordinance shall not apply to any application for any residential development which is to be owned and operated by a housing authority. Section 4. The restrictions contmned in this ordinance also shall not be construed to affect any residential development or use under a fmal Planned Unit Development (PUD) development plan, special review use, or PCZD general development plan which has been finally approved by resolution of the Louisville City Council and which is in conformance with all ordinances, resolutions, mles, regulations, policies and conditions applicable to such approval, or to affect any final PUD development plan for which a complete application has been filed with the Planning Department prior to the effective date hereof. Section 5. The provisions of this ordinance are temporary in nature and may be repealed by a subsequent legislative enactment. The temporary moratorium established by this ordinance shall temmnate as of March 31, 2005 unless sooner repealed. Section 6. If any portion of this ordinance is held to be invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have passed this ordinance and each part hereof irrespective of the fact that anyone part be declared invalid. 2
