Absent: Councilor Clabots. <br /> APPROVE 944 GARFIELD PUBLIC TRAIL IMPROVEMENT AGREEMENT AND <br /> EASEMENT VACATION 1 Reading <br /> RESOLUTION No. 40, SERIES 2011 A RESOLUTION APPROVING AN <br /> AGREEMENT CONCERNING A PUBLIC PEDESTRIAN AND BICYCLE TRAIL <br /> CONNECTING GARFIELD AVENUE TO LINCOLN AVENUE <br /> Mayor Sisk requested a staff presentation. <br /> Planning Director Russ explained the ordinance if authorized approves a draft <br /> agreement between the City and the home owner of 944 Garfield Avenue. The <br /> homeowner conveys an approximate thirteen foot (13') parcel across the northernmost <br /> portion of the Property in exchange for the City vacating its interest in the 17 -foot <br /> easement. <br /> Background: In 1993 Boulder County acquired a public easement on the northern 17- <br /> feet of 944 Garfield Avenue. The easement was designated for "public purpose to be <br /> used as a pedestrian and bicycle walkway and vehicle access for the CL Ditch. The CL <br /> Ditch is serviced by the Mayhoffer Ditch Company and they only require access for a <br /> truck. The easement was to formalize an existing pedestrian and bicycle connection <br /> between Garfield Avenue and Lincoln Avenue. In 2008 the homeowner built a driveway <br /> and landscaping in the Boulder County easement. The Louisville Planning and Building <br /> Safety staff was not aware of the modifications to the easement as the construction <br />
