The <br /> homeowner modifications to the easement restricted vehicle access. <br /> The City of Louisville acquired the rights to the easement from Boulder County in 2010. <br /> The easement will connect Garfield Avenue to Lincoln Avenue; the walkway connects <br /> McKinley Park to Old Town and continues as a critical link in connecting the Goodhue <br /> Ditch Trail to Downtown Louisville via South Street. The homeowner conveys an <br /> approximate thirteen foot (13') parcel across the northernmost portion of the Property in <br /> exchange for the City vacating its interest in the 17 -foot easement. Specifically, the <br /> homeowner agrees, at its expense, to stain and seal the driveway a dark gray color and <br /> reimburse the City for constructing the following improvements: <br /> Install the City Parks and Recreation Department standard split -rail fence <br /> between the Trail and the Owner's house; <br /> Relocate boulders placed in the easement to the south side of the proposed <br /> fence; <br /> Widen the trail opening at Garfield Avenue using a crusher fine material; and <br /> Install two "Caution Driveway" signs in a form and size and location mutually <br /> approved by the City and Owner. <br /> The City will receive the warranty deed at no cost. Improvements to the trail will be paid <br /> for by the homeowner. There will be no change in the long -term maintenance cost <br /> between the public easement and property ownership. Staff recommended approving <br /> Resolution No. 40, Series 2011 authorizing the City Manager to enter the City into an <br /> agreement with the Property Owners of 944 Garfield Avenue concerning improvements <br /> to a public pedestrian and bicycle trail connecting Garfield Avenue to Lincoln Avenue. <br /> Staff also recommended City Council approve Ordinance 1599, Series 2011 approving <br /> the vacation of an existing easement located on a portion of Lot 1, Block 1, Louisville <br /> Heights Addition in the City of Louisville on first reading and set second reading and <br /> public hearing for November 1, 2011. The second reading shall occur after: <br /> 1. Improvements to the trail are approved by both the homeowner and the City; <br /> 2. A license agreement permitting the homeowner access to the property has been <br /> signed by both parties; and <br /> 3.
