Staff has concluded any buffer around residential areas would <br />effectively eliminate the possibility of medical marijuana operations <br />in the City and would be in conflict with City Council’s November <br />16, 2010 direction not to outlaw medical marijuana businesses, but <br />to regulate them. <br />Russ continued with a review of the revisions to the Title 17 Ordinance as <br />provided in the document presented and entered into public record at this <br />meeting. <br />Commission Questions of Staff <br />Loo discussed the words “playground, pool” as they appear in the definition. <br />Sam Light, City Attorney, stated there is no need for additional definitions. <br />Loo asked for an explanation of how a door can provide protection. <br />Light explained it provides a method of limiting access in and out of a specific <br />site/area. <br />Sheets discussed the accessibility of a pool area at a hotel and a playground at <br />an apartment complex. <br />Russell requested a clarification of public park. <br />Russ discussed the difference between an active and a non-active park. He <br />stated a park can be a general use while a playground has a very specific use. <br />Russell, Russ and Light discussed the importance of providing a residential <br />buffer, how to regulate outdoor educational facilities serving school age children <br />and open space. <br />Lipton asked why the 1,320 foot or ¼ mile buffer had been selected. <br />Russ stated the ¼ mile distance is an industry standard. It is the maximum <br />distance most people will walk and it takes about 5 minutes. <br />Lipton and Light discussed cultivation. Light clarified the ability to allow infused <br />products. A grow center must be licensed and kept confidential. Light also <br />discussed the timing of the City Ordinances and the importance of having the city <br />regulations in place prior to any further action by the state. Light concluded with a <br />clarification of the hotel pool concern. He stated the pool would be private and <br />would be regulated by the hotel management. <br />Loo discussed her understanding of the publicly owned playground and publicly <br />owned outdoor pool and how it applies to the ordinance. <br />Public Comment <br />Pam Simpson, 1502 Corinth, Lafayette, thanked the commission for the time they <br />have taken to review the regulations for medical marijuana. <br />Summary Comments and Request from Staff and/or Applicant <br /> <br /> <br />
