The vested property right would last 3 years, beginning on the date of the City Council <br />public hearing approving the site specific development plan. If amendments to the plan <br />were subsequently made, those would not extend the vesting period from that which was <br />established with the original approval, unless City Council specifically acted to extend <br />the period through the resolution of approval. <br /> <br />City Council would have the ability to enter into an agreement with a property owner that <br />could extend a vesting period for a project (possibly a multi-phase project) for a period <br />longer than 3 years. <br /> <br />The City Administrator would set the application fee, as with all other land use <br />application fees. The ordinance also proposes a minor modification to the current PUD <br />section of the zoning code regarding the link between preliminary and final PUD. <br /> <br />The ordinance is proposed to be adopted as an emergency to meet the January 1, 2000 <br />deadline established in the statute. <br /> <br />There have been some minor amendments to the Ordinance since first reading. Those <br />changes do not have any substantive impact on the Ordinance. The changes are intended <br />to clarify that any approval of a preliminary PUD should not be construed as granting any <br />statutory vesting rights. <br /> <br />As a proposed amendment to the zoning code, the Planning Commission is required to <br />review the Ordinance and forward a recommendation to City Council. On November 18, <br />the Planning Commission held a public hearing on the Ordinance. They moved forward <br />Resolution 4/55, Series 1998, which recommends approval, without modification. The <br />Planning Commission approved the resolution unanimously (6 - 0). <br /> <br />Davidson opened the public hearing and called for anyone wishing to speak on Ordinance <br />No. 1313, Series 1999. <br /> <br />NONE <br /> <br />Davidson closed the public hearing and called for Council comments and questions. <br /> <br />Howard moved that Council approve Ordinance No. 1313, Series 1999 - An Ordinance <br />Amending Title 17 and Adopting a New Chapter 17.54, Statutory Vested Property Rights <br />on second reading, seconded by Mayer. <br /> <br />Light offered a friendly amendment clarifying that there are some secOnd reading <br />amendments contained in the Ordinance, which would be included in the Ordinance. <br /> <br />Friendly amendment accepted by Howard and Mayer. <br /> <br />Roll call was taken. Motion passed by a vote of 6-0. <br /> <br /> <br />
