Planning Commission
Meeting Minutes
APRIL 12, 2007

Public Notice Certification:
Continued from the March 8, 2007 meeting. Reposted in City Hall, Library, Recreation Center
and the Police and Courts Building.

Note: Dalton arrived at 6:40 PM

Conflict ofInterest and Disclosure:
None heard.

Staff Report of Pacts and Issues:
Wood summarized the staff report with the following points:
. Resolution No.7, Series 2007 was initiated by staff and it proposes to repeal
amendments by Ordinance No. 1511, Series 2007 to the Louisville Municipal Code
(LMC) which were adopted initially by Ordinance No. 1397, Series 2002.
. Ordinance No. 1397 modified Section 17.20.160 of the LMC, pertaining to
limitations of parking motor vehicles on private property within front and side yard
setbacks.
. Ordinance 1397 added the following language concerning "trailers":
. No trailer may be parked in the front yard of a residential lot for more than 72
hours.
. No trailer may be parked on the side yard unless the side yard is enclosed with
a privacy fence at least 4 feet in height, and not more than 6 feet in height.
. The privacy fence cannot obstruct the vision clearance requirements.
. Enforcement of Ordinance No. 1397 was suspended by the previous Mayor due to the
range of public comments received by the City.
. Assuming Ordinance No 1511 is approved and becomes effective the LMC would
continue to enforce ordinances related to junk, parking of oversized vehicles and
detached trailers in the public right-of-way, and the parking of motor vehicles on
private property.
. The following sections of the LMC would remain in effect:
. Section 8 - Health and Safety
~ Section 8.16 - definition of junk
~ Section 8.16.040 - Inoperable Vehicles and Repair Work
~ Section 8.16.040.D.2 - Definition of Motor Vehicle
. Section 10.20 - Vehicle Parking
~ Section 10.20.010 - No trucks or buses...
~ Section 10.20.0303 - Trailers defined as ...
~ Section 10.20.0505 - No bus, trailer coach...
~ Section 10.20.070 - No person shall...
. Section 17.20.160 - parking of "motor vehicles" on a private residential lot.

Wood concluded by stating the LMC will continue to provide enforcement of junk and
inoperable motor vehicles, the parking of oversized vehicles and detached trailers in the public
right-of-way, and the ability to require motor vehicles parked on private property either be on a
driveway or screened from view by a six foot privacy fence. The LMC would not address the
extent to which private property owners would be able to park and store detached trailers,
recreational vehicles, campers, and boats on private residential lots.

Wood stated staff recommends the approval of Resolution No.7, Series 2007 without condition.
