<br />Chapter. The applicant shall also provide an affidavit stating that capacity will be <br />available to other providers. <br /> <br />17.42.080. Admini~trative Special Review Use Process. The Administrative Special <br />Review Process is intended to encourage CMRS facilities in the most appropriate locations. <br />At the Preapplication conference, the Planning Director will make a preliminary determination <br />on the eligibility of the proposal for an Administrative Special Review Use. If determined to <br />be eligible under the criteria set forth in Sections 17.42.020 and 17.42.030, the following <br />schedule and requirements shall apply. <br /> <br />A. The applicant shall submit five copies of a full application as noted in Section <br />17.042.060, excluding 'L' and any other application requirements that the Director <br />may waive at the preapplication conference. <br /> <br />B. Within 21 calendar days of receipt of a full application, the Director shall provide <br />written comments to the applicant setting forth any modifications required to bring the <br />proposal into full compliance with the requirements of this Chapter. <br /> <br />C. After making the required modifications to the proposal, posting any required letter <br />of credit and receiving approval of the application from the Director, the applicant shall <br />submit two complete sets of mylars, along with applicable recording fees to the <br />Director. <br /> <br />D. Building permit applications will be accepted only after meeting the above <br />requirements . <br /> <br />E. In the event any dispute arises regarding required modifications to the proposal, and <br />such dispute cannot be resolved the Director and the applicant, the application shall be <br />submitted to the to the Planning Commission and City Council through the normal <br />Special Review Use public hearing process. <br /> <br />F. Non-administrative review applications will be acted upon according to the decision <br />criteria set forth in the special review use, or the provisions of this code, whichever is <br />applicable. <br /> <br />17.42.100. Special Provisions. <br /> <br />A. Recording Requirements. Approved Administrative and Special Review Uses are <br />required to be recorded in Mylar form with the Office of The Clerk and Recorder of <br />Boulder County, and filed with the City of Louisville Planning Department. County <br />recording fees shall be paid by the applicant. <br /> <br />B. Transfer of Approved Special Review Uses. Any approval of a CMRS facility is <br />specific to the Provider represented at the time of application. Any modification to an <br /> <br />14 <br />
