<br />ORDINANCE NO. 1252 <br />SERIES 1997 <br /> <br />AN ORDINANCE OF THE CITY OF LOUISVILLE, COLORADO, <br />DECLARING AN EMERGENCY; ESTABLISHING A TEMPORARY <br />MORATORIUM ON THE PROCESSING OF APPLICATIONS FOR PERMITS <br />FOR PLACEMENT, CONSTRUCTION OR MODIFICATION OF WIRELESS <br />TELECOMMUNICATION SERVICE FACILITIES WITHIN THE CITY <br />LIMITS OF THE CITY OF LOUISVILLE; AND CREATING CERTAIN <br />EXEMPTIONS THEREFROM. <br /> <br />WHEREAS, the City of Louisville, Colorado, is a statutory <br />municipality existing under and by virtue of the laws of the State <br />of Colorado; and <br /> <br />WHEREAS, C.R.S. ~31-23-301 et ~ authorizes the City to <br />establish zoning districts and zone district regulations within the <br />City to, among other things, promote the general welfare of the <br />inhabitants of the City; and <br /> <br />WHEREAS, pursuant to C.R.S. ~31-23-303(1), such zoning <br />regulations shall be made with reasonable consideration, among <br />other things, as to the character of each district and its peculiar <br />suitability for particular uses, and with a view to conserving the <br />value of buildings and encouraging the most appropriate use of land <br />throughout the City; and <br /> <br />WHEREAS, pursuant to such authorities, the City has <br />established zoning districts and zoning regulations as codified in <br />Title 17 of the Louisville Municipal Code; and <br /> <br />WHEREAS, pursuant to such authorities, the City has to date <br />received three requests for approval of the placement of wireless <br />telecommunications service facilities in the City, which use is <br />currently a special review uses in all zone districts; and <br /> <br />WHEREAS, by administrative amendments to approved, final <br />planned unit development plans, the City has approved two such <br />requests, each of which allows placement of roof-mounted, wireless <br />telecommunications service facilities on existing commercial <br />structures within the City, subject to terms and conditions; and <br /> <br />1 <br />
