ORDINANCE NO. 1252 SERIES 1997 AN ORDINANCE OF THE CITY OF LOUISVILLE, COLORADO, DECLARING AN EMERGENCY; ESTABLISHING A TEMPORARY MORATORIUM ON THE PROCESSING OF APPLICATIONS FOR PERMITS FOR PLACEMENT, CONSTRUCTION OR MODIFICATION OF WIRELESS TELECOMMUNICATION SERVICE FACILITIES WITHIN THE CITY LIMITS OF THE CITY OF LOUISVILLE; AND CREATING CERTAIN EXEMPTIONS THEREFROM. WHEREAS, the City of Louisville, Colorado, is a statutory municipality existing under and by virtue of the laws of the State of Colorado; and WHEREAS, C.R.S. ~31-23-301 et ~ authorizes the City to establish zoning districts and zone district regulations within the City to, among other things, promote the general welfare of the inhabitants of the City; and WHEREAS, pursuant to C.R.S. ~31-23-303(1), such zoning regulations shall be made with reasonable consideration, among other things, as to the character of each district and its peculiar suitability for particular uses, and with a view to conserving the value of buildings and encouraging the most appropriate use of land throughout the City; and WHEREAS, pursuant to such authorities, the City has established zoning districts and zoning regulations as codified in Title 17 of the Louisville Municipal Code; and WHEREAS, pursuant to such authorities, the City has to date received three requests for approval of the placement of wireless telecommunications service facilities in the City, which use is currently a special review uses in all zone districts; and WHEREAS, by administrative amendments to approved, final planned unit development plans, the City has approved two such requests, each of which allows placement of roof-mounted, wireless telecommunications service facilities on existing commercial structures within the City, subject to terms and conditions; and 1
