<br />WHEREAS, there is an increasing demand for personal wireless <br />telecommunication services, in light of rapid changes in wireless <br />telecommunications technology, the recent auction and granting of <br />licenses by the Federal Communications Commission which has <br />resulted in the identification of those entities that will be the <br />providers of such services in the area, and the increasing <br />availability of such services; and <br /> <br />WHEREAS, the City anticipates additional requests for <br />placement of such facilities in the City; and <br /> <br />WHEREAS, the City of Louisville has well-defined areas of <br />residential and non-residential use, and is a community which <br />places significant emphasis in land use planning upon the <br />preservation of open space and view corridors, the minimization or <br />mitigation of impacts of potentially incompatible uses, and the <br />preservation of the integrity of residential areas; and <br /> <br />WHEREAS, the City has only a limited number of appropriate and <br />compatible sites and areas for the placement of wireless; and <br /> <br />WHEREAS, the federal Telecommunications Act of 1996, enacted <br />on February 8, 1996, affects the ability of the City to regulate <br />the placement, construction, and modification of wireless <br />telecommunication service facilities in the City; and <br /> <br />WHEREAS, the citizens of the City have expressed significant <br />concerns relating to the siting of wireless telecommunication <br />service facilities within the City, including concerns about the <br />proliferation of these facilities; the technical bases for the <br />spacing and siting of these facilities, including the feasibility <br />of co-location; the types and variety of design of these <br />facilities; the effects on these facilities on open space, view <br />corridors, the rural character of arterial streets and other <br />aesthetic resources; the potential placement of these facilities in <br />inappropriate areas or zone districts within the City; the safety <br />of these facilities; and the impact of these facilities upon <br />property values; and <br /> <br />WHEREAS, the citizens of the City have also expressed their <br />desire, and the City Council desires, that the City receive <br /> <br />2 <br />
