adequate and beneficial wireless telecommunication services, provided facilities for such services are designed, located, and regulated in a manner that appropriately addresses the citizens' concerns; and WHEREAS, since the passage of the Federal Telecommunications Act of 1996, the City has received information from the industry, governmental agencies, and others establishing that wireless telecommunication facilities can be designed, installed, constructed and regulated in a manner that addresses the citizens' concerns; and WHEREAS, the City requires additional time to study such information, to study the effects of the Telecommunications Act of 1996 upon the City's ability to regulate wireless telecommunication service facilities, and to prepare and consider appropriate regulations, to ensure that applications for wireless telecommunications facilities are processed, and such facilities are designed, installed, constructed and regulated, in a manner that ensures the citizens' concerns are addressed, that adequate and beneficial services are provided, and that competing providers of such providers of functionally equivalent services have adequate access to existing sites; and WHEREAS, the Louisville Planning Commission, after notice by publication and a public hearing, has recommended the City Council's approval of a moratorium as set forth in this ordinance. WHEREAS, City Council has provided notice of a public hearing on said ordinance by publication as provided by law and held a public hearing as provided in said notice. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LOUISVILLE, COLORADO: Section 1. The foregoing recitals are hereby affirmed and incorporated herein by this reference as findings of the City Council. Section 2.
