<br />adequate and beneficial wireless telecommunication services, <br />provided facilities for such services are designed, located, and <br />regulated in a manner that appropriately addresses the citizens' <br />concerns; and <br /> <br />WHEREAS, since the passage of the Federal Telecommunications <br />Act of 1996, the City has received information from the industry, <br />governmental agencies, and others establishing that wireless <br />telecommunication facilities can be designed, installed, <br />constructed and regulated in a manner that addresses the citizens' <br />concerns; and <br /> <br />WHEREAS, the City requires additional time to study such <br />information, to study the effects of the Telecommunications Act of <br />1996 upon the City's ability to regulate wireless telecommunication <br />service facilities, and to prepare and consider appropriate <br />regulations, to ensure that applications for wireless <br />telecommunications facilities are processed, and such facilities <br />are designed, installed, constructed and regulated, in a manner <br />that ensures the citizens' concerns are addressed, that adequate <br />and beneficial services are provided, and that competing providers <br />of such providers of functionally equivalent services have adequate <br />access to existing sites; and <br /> <br />WHEREAS, the Louisville Planning Commission, after notice by <br />publication and a public hearing, has recommended the City <br />Council's approval of a moratorium as set forth in this ordinance. <br /> <br />WHEREAS, City Council has provided notice of a public hearing <br />on said ordinance by publication as provided by law and held a <br />public hearing as provided in said notice. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />Section 1. The foregoing recitals are hereby affirmed and <br />incorporated herein by this reference as findings of the City <br />Council. <br /> <br />Section 2. As used in this <br />telecommunication service facilities" shall <br />as "personal wireless service facilities" as <br /> <br />ordinance "wireless <br />have the same meaning <br />defined in Section 704 <br /> <br />3 <br />
