City Council <br /> Meeting Minutes <br /> August 2, 2011 <br /> Page 5 of 12 <br /> ORDINANCE No. 1598, SERIES 2011 AN ORDINANCE AMENDING CHAPTER <br /> 4.03 OF THE LOUISVILLE MUNICIPAL CODE TO MAKE THE PROVISIONS OF <br /> SUCH CHAPTER CONSISTENT WITH THE OPEN SPACE PROVISIONS OF <br /> ARTICLE 15 OF THE LOUISVILLE HOME RULE CHARTER, AND AMENDING <br /> CHAPTER 4.02 OF THE LOUISVILLE MUNICIPAL CODE REGARDING TERMS OF <br /> OFFICE FOR THE LOUISVILLE CITIZEN OPEN SPACE ADVISORY BOARD- 2nd <br /> Reading <br /> Mayor Pro Tem Marsella requested a City Attorney introduction. <br /> City Attorney Light introduced Ordinance No. 1597 and Ordinance No. 1598, Series <br /> 2011. He noted during the public hearing, the public may comment on either item. <br /> Mayor Pro Tem Marsella opened the public hearing and requested a staff presentation. <br /> Planner McMillan explained Ordinance No. 1598, Series 2011 amends Title 4 of the <br /> LMC to ensure the classification and management described in the City Charter is <br /> enacted in the City Code. Ordinance 1598, Series 2011 also includes modifications to <br /> Section 4.02.010.B of the LMC to change the terms for Open Space Advisory Board <br /> (OSAB) members to begin on January 1 and end on December 31. The terms for OSAB <br /> members currently terminate on January 15. <br /> Ordinance No. 1597, Series 2011 establishes the Open Space Zone District. He noted <br /> there is not an open space zone district in the City of Louisville and in order to bring the <br /> Louisville Municipal Code (LMC) into compliance with the City Charter, the Planning <br /> Staff and the Parks and Recreation Department have initiated the process of amending <br /> the LMC. There are three (3) objectives associated with this process: <br /> 1. Establish the Open Space Zone District. <br /> 2. Rezone City Owned Properties to Open Space. (Hillside, Davidson Mesa, and <br /> Damyanovich). <br /> 3. Amend Title 4 of the LMC to ensure the classification and management <br /> described in the City Charter is enacted in the City Code. <br /> Mayor Pro Tem Marsella requested public comments on either Ordinance No. 1597 or <br /> 1598, Series 2011, and hearing none, closed the public hearing. <br /> ORDINANCES No. 1597, SERIES 2011 AN ORDINANCE AMENDING TITLE 17 OF <br /> THE LOUISVILLE MUNICIPAL CODE TO CREATE AN OPEN SPACE ZONE <br /> DISTRICT AND DISTRICT REGULATIONS, AND REZONING CERTAIN CITY <br /> OWNED PARCELS TO OPEN SPACE <br /> MOTION: Councilor Muckle moved to approve Ordinance No. 1597, Series 2011, <br /> seconded by Councilor Dalton. Roll call vote was taken. The motion carried by a vote of <br /> 5 -0. Absent: Mayor Sisk and Councilor Sackett. <br />
