<br />City Council <br />Meeting Minutes <br />February 6, 2007 <br />Page 10 of 18 <br /> <br />Eileen Patrick asked whether the minimum 2008 payment amount would go <br />under Section 1 or Section 4B. She also inquired about the reference to an <br />advisory group to study the number. She asked what authority the advisory <br />group would have. <br /> <br />City Attorney Light stated that under the suggested revisions, paragraph 1 of the <br />agreement would cross-reference Section 4B and Section 4B would set the <br />methodology for determining the dollar amount of an additional payment over the <br />minimum amount. The library task force would look at the data and make a <br />recommendation. <br /> <br />Mark Appelfeller, 424 Owl Driive, Louisville, CO felt the Town of Superior should <br />be given the opportunity to pay for the operating expenses for the old library, <br />instead of the operating expenses for the new library. He noted the Town of <br />Superior had no vote in the bond issue for the new library. <br /> <br />Lisa Kahn, 304 S. McKinley Court, Louisville, CO, Library Board member, agreed <br />with the increase in Superior's payment in the 2nd year of the agreement. <br /> <br />Mayor Pro Tem Brown explained by statute, municipalities having libraries must <br />provide reciprocity of library facilities to others; however Superior does not have <br />a library. <br /> <br />MOTION: Mayor Pro Tem Brown moved to approve Resolution No. 10, Series <br />2007, with the following changes: In the last Whereas, remove the words "capital" <br />and"; in paragraph 1, insert after the title "subject to paragraph to paragraph 4B"; <br />and change the 2008 Contribution to read "shall contribute a minimum of <br />$105,000 to Louisville; in 2B delete the word "each" in the second line and <br />pluralize the word "users" in the second line; On Page 2, paragraph 2, delete the <br />word "that" and pluralize the word "users"; In 4B add a phrase at the end to read <br />"in particular if it is determined the information provided pursuant to paragraph 2 <br />supports Louisville's requestHd contribution, then Superior shall increase its 2008 <br />payment above $105,000 to an amount that represents a reasonable <br />approximation of Superior's pro rata share of the 2008 operating budget for the <br />library. If Superior's payment is not so increased, then Louisville may terminate <br />their agreement effective 1/3'1108." Council member Muckle seconded the <br />motion. <br /> <br />Council member Muckle offelred a friendly amendment to Section 5B, to add the <br />following language after "poliGies", "and access to Superior's recreation facilities, <br />by Louisville residents." Council member Brown suggested the language remain <br />neutral in this IGA, as that issue could be one of the items later discussed. <br /> <br />Council member Marsella requested a housekeeping amendment; in Paragraph <br />3, to change the paragraph n3ferences for 5,6, and 7, to 4, 5 and 6. <br />
