All in favor. <br /> <br />ORDINANCE No. 1513, SEFUES 2007 - AN ORDINANCE AMENDING CERTAIN <br />SECTIONS OF TITLES 16 AND 17 OF THE lOUISVlllE MUNICIPAL CODE <br />CONCERNING CITY COUNCil REVIEW OF PRELIMINARY SUBDIVISION PLATS <br />AND PRELIMINARY DEVELOPMENT PLANS - 2nd reading - Public Hearing <br /> <br />Mayor Sisk requested a City Attorney introduction. <br /> <br />City Attorney Light read Ordinance No. 1513, Series 2007. <br /> <br />Mayor Sisk requested a Staff pnesentation. <br /> <br />Planning Director Wood explain1ed Sections 16.12.030.C (Subdivision Code), and <br />17.28.170.8 (PUD Code) of the Louisville Municipal Code were added to the code in <br />1993 to modify the developmen1t review process to provide for informal City Council <br />comments on a preliminary development application. These sections of the LMC <br />provide Council informal review of a preliminary plat or preliminary PUD prior to <br />submission to the Planning Commission. No action was to be taken by the City Council <br />on the preliminary plan other than transmit the plan to the Planning Commission. The <br />nature of such an exchange was considered by the code as being non-binding upon the <br />City Council. <br /> <br />At Council's direction the practice of forwarding preliminary documents to City Council <br />was discontinued. The proposed ordinance modifies the land use review process to <br />require certain preliminary plats and PUD development plans go to the City Council after <br />review by the Planning Commission. Currently, City Council only reviews preliminary <br />plats in the event of an appeal or call up, and preliminary plans coupled with a <br />preliminary plat if appealed or called up. This ordinance changes the procedures by <br />directing preliminary submittals to City Council review if the application meets one of the <br />following criteria: <br /> <br />1. Multi-family project. <br />2. Single family developments exceeding six units. <br />3. A preliminary developmEmt application requiring a Special Review Use. <br />4. A preliminary developmEmt request seeking relief from the underlying zoning as <br />set forth in titles 16 and 17 of this code or any relief from applicable provisions of <br />the Commercial Development Design Standards and Guidelines or the Industrial <br />Development Design Standards and Guidelines. <br /> <br />The effect of the proposed ordinance does not require development applications, which <br />would otherwise be submitted as final plats and PUDs to be processed as preliminary <br />submittals. Those applications meeting the criteria for final submission would continue <br />to be submitted as finals and processed in accordance with the standing process and <br />timelines. It is not the intent to require a new preliminary PUD process for a <br />development otherwise eligible for expedited PUD review under current Section <br />17.28.250. <br />
