Roll <br />call vote was taken. The motion carried by a vote of 7-0. <br /> <br />EXECUTIVE SESSION - PEI~DING LITIGATION - (Louisville Charter, Section <br />5-2(d) - Authorized Topics - uConsultation with an attorney representing the City <br />with respect to pending Iitigatiion" and C.R.S. Section 24-6-402(4) (b). <br /> <br />City Attorney Light requested the City Council convene an executive session for <br />the purpose of consultation with respect to pending litigation (John D. Mayhoffer <br />and Jeane A. Mayhoffer as Tlrustees of the John D. Mayhoffer Trust; Leannah <br />Mayhoffer Baron and Robert Patrick Mayhoffer v. Aquarius Development Co., <br />City of Louisville, et.al, Case INo. 05 CV1136). <br /> <br />City Clerk Varra read Section 2.90.050 "Public Statements" of the Louisville <br />Municipal Code, which governs the topics discussed in executive session. <br /> <br />City Attorney Light stated the authority for Executive Session is provided through <br />the Home Rule Charter, Section 5-2(d) and C.R.S. Section 24-6-402(4) (b). <br /> <br />MOTION: Mayor Sisk moved the Council adjourn to executive session to discuss <br />pending litigation, and requested City Attorney Light, Water Attorney Hill, Interim <br />City Manager Balser and Public Works Director Phare be included in the <br />executive session. Council member Yarnell seconded the motion. All in favor. <br /> <br />Council went into executive session at 9:25 p.m. <br /> <br />REGULAR BUSINESS ITEMS SUSPENDED <br /> <br />Mayor Sisk reconvened the Regular Business Meeting at 10:05 p.m., and <br />requested the City Attorney n9port on the Executive Session. <br /> <br />City Attorney Light reported in the executive session Council discussed <br />settlement options in the Mayhoffer litigation. There was Council consensus on <br />the settlement option, which would be pursued. <br /> <br />City Attorney Light stated the final settlement documents would be a consent <br />agenda item at the May 23, 2~007 Special Council meeting. <br /> <br />CITY ATTORNEY'S REPORT <br /> <br />City Attorney Light will forward Council a memo regarding the filing on the City's <br />ICMA Plan. <br /> <br />COUNCIL COMMENTS AND COMMITTEE REPORTS <br />
