<br />City Council <br />Meeting Minutes <br />July 2, 2007 <br />Page 7 of 9 <br /> <br />the south side of the building and will maintain a side yard setback of 8 feet from <br />the southern property boundary. The existing structure at 733 Jefferson Avenue <br />is located 14 feet adjacent from the 725 Jefferson Avenue property. <br /> <br />No modifications to the external operations of the school are being proposed. <br />Parking would remain the same, with staff parking at the rear, off the alley. The <br />drop off location along Jefferson would also continue in the same manner. The <br />exterior play area will also remain in the same location. <br /> <br />COUNCIL COMMENT <br /> <br />Council member Clabots askl3d if notice was served to the resident at 725 <br />Jefferson Avenue. McCartney confirmed notice was served. <br /> <br />City Attorney Light explained the intent is once 733 Jefferson is occupied, the <br />prior Special Review Use approval on 741 Jefferson Avenue will be cancelled. <br />He suggested a note be put on the PUD and amending the resolution. He <br />requested the motion include cancelling the Special Review Use on 741 <br />Jefferson Avenue. <br /> <br />Curtis Manning, 725 Jefferson Avenue, Louisville, CO voiced his concern over <br />the new addition to the commercial property at 733 Jefferson, which is located in <br />a residential area. His concern centered on his property being impacted by the <br />addition and possible changes in hours of the school. <br /> <br />Principal Planner McCartney stated the addition to 733 Jefferson is located on <br />the south side of the property however there is adequate separation between the <br />properties. He noted the uses or hours will not change and there will not be any <br />drastic change to the neighborhood. <br /> <br />Council member Clabots asked for clarification that the Special Review Use <br />approval for 741 Jefferson Avenue would be cancelled and if the applicant <br />wished to utilize that property again it would require a new Special Review Use <br />Application and a Planning Commission review. City Attorney Light confirmed <br />the process outlined by Council member Clabots was correct. <br /> <br />MOTION: Council member Muckle moved to approve Resolution No. 33, Series <br />2007 as amended, and the Special Review Use approval for 741 Jefferson <br />Avenue be cancelled at the first occupancy of the addition at 733 Jefferson <br />Avenue. Council member Clabots seconded the motion. All in favor.
