\ \1111\ 11111 \11111\ 111\ 1111I1 III 1111111 1111111\ 1I11 1111 ~~;~~r;?~, Boulder County Clerk, CO ORD R 26.00 D 0.00 ORDINANCE NO. 1519 SERIES 2007 AN ORDINANCE ADOPTING A NEW SECTION 17.12.055 OF THE LOUISVILLE MUNICIPAL CODE REGARDING PRESERVATION ZONING INCENTIVES FOR THE OLD TOWN OVERLAY DISTRICT AND AMENDING SECTION 17.12.050 OF THE LOUISVILLE MUNICIPAL CODE REGARDING ROOF DESIGN CRITERIA FOR SUCH DISTRICT WHEREAS, the City of Louisville is a Colorado home rule municipal corporation duly organized and existing under laws of the State of Colorado and the City Charter; and WHEREAS, pursuant to such home rule authority and state law, including but not limited to C.R.S. 9924-67-101 et seq., 29-20-101 et seq., 31-23-201 et seq. and 31-23-301 et ~ the City is empowered to adopt zoning, subdivision, planned unit development and building regulations, standards and guidelines; and WHEREAS, the City has adopted a historic preservation ordinance which is codified in Chapter 15.36 of the Louisville Municipal Code and which ordinance has as its purpose, among others, the promotion of preservation of those places and structures in Louisville which are of historical, cultural, social and architc:ctural significance to the community; and WHEREAS, the City desires to promote the preservation of such places and structures by encouraging and rewarding their designation as landmarks or districts on the Louisville Register of Historic Places, and by encouraging and rewarding building activities that preserve structures and features of historic architectural significance; and WHEREAS, the City's zone districts include the Old Town overlay district, which district encompasses the historical Old Town residential area of the city and provides for regulations intended to maintain the existing character of the area in the district; and WHEREAS, the City by this ordinance desires to establish certain preservation zoning incentives to encourage the preservation of houses and maintain the street level character of residential areas in the district; and WHEREAS, the Louisville Historic Preservation Commission has forwarded this ordinance to the City Council with a recommendation of approval; and WHEREAS, the Louisville Planning Commission, after notice by publication and a public hearing, has recommended the City Council approve the amendments to the Louisville Municipal Code set forth in this ordinance; and WHEREAS, the City Council has considered the recommendations of the Historic Preservation Commission and the Plmming Commission concerning the adoption of this ordinance, and has held a duly noticed public hearing on this ordinance; and 1 CO( 7'.10 ILL-
