<br />\ \1111\ 11111 \11111\ 111\ 1111I1 III 1111111 1111111\ 1I11 1111 ~~;~~r;?~, <br /> <br />Boulder County Clerk, CO ORD <br /> <br />R 26.00 <br /> <br />D 0.00 <br /> <br />ORDINANCE NO. 1519 <br />SERIES 2007 <br /> <br />AN ORDINANCE ADOPTING A NEW SECTION 17.12.055 OF THE LOUISVILLE <br />MUNICIPAL CODE REGARDING PRESERVATION ZONING INCENTIVES FOR THE <br />OLD TOWN OVERLAY DISTRICT AND AMENDING SECTION 17.12.050 OF THE <br />LOUISVILLE MUNICIPAL CODE REGARDING ROOF DESIGN CRITERIA FOR <br />SUCH DISTRICT <br /> <br />WHEREAS, the City of Louisville is a Colorado home rule municipal corporation duly <br />organized and existing under laws of the State of Colorado and the City Charter; and <br /> <br />WHEREAS, pursuant to such home rule authority and state law, including but not limited <br />to C.R.S. 9924-67-101 et seq., 29-20-101 et seq., 31-23-201 et seq. and 31-23-301 et ~ the City <br />is empowered to adopt zoning, subdivision, planned unit development and building regulations, <br />standards and guidelines; and <br /> <br />WHEREAS, the City has adopted a historic preservation ordinance which is codified in <br />Chapter 15.36 of the Louisville Municipal Code and which ordinance has as its purpose, among <br />others, the promotion of preservation of those places and structures in Louisville which are of <br />historical, cultural, social and architc:ctural significance to the community; and <br /> <br />WHEREAS, the City desires to promote the preservation of such places and structures <br />by encouraging and rewarding their designation as landmarks or districts on the Louisville <br />Register of Historic Places, and by encouraging and rewarding building activities that preserve <br />structures and features of historic architectural significance; and <br /> <br />WHEREAS, the City's zone districts include the Old Town overlay district, which <br />district encompasses the historical Old Town residential area of the city and provides for <br />regulations intended to maintain the existing character of the area in the district; and <br /> <br />WHEREAS, the City by this ordinance desires to establish certain preservation zoning <br />incentives to encourage the preservation of houses and maintain the street level character of <br />residential areas in the district; and <br /> <br />WHEREAS, the Louisville Historic Preservation Commission has forwarded this <br />ordinance to the City Council with a recommendation of approval; and <br /> <br />WHEREAS, the Louisville Planning Commission, after notice by publication and a public <br />hearing, has recommended the City Council approve the amendments to the Louisville Municipal <br />Code set forth in this ordinance; and <br />WHEREAS, the City Council has considered the recommendations of the Historic <br />Preservation Commission and the Plmming Commission concerning the adoption of this ordinance, <br />and has held a duly noticed public hearing on this ordinance; and <br /> <br />1 <br /> <br />CO( 7'.10 <br /> <br />ILL- <br />
