<br />RESOLUTION NO. 29 <br />SERIES 2007 <br /> <br />A RESOLUTION APPROVING A PURCHASE CONTRACT TO BUY AND SELL REAL <br />ESTATE FOR OPEN SPACE AND OTHER PURPOSES, INCLUDING SUBDIVISION <br />AND SALE OF A PORTION OF SUCH PROPERTY TO DEFRAY THE COSTS OF <br />ACQUISITION, AND APPROVING A PURCHASE AGREEMENT FOR THE SALE TO <br />BOULDER COUNTY OF CONSERVATION EASEMENTS IN PORTIONS OF SUCH <br />PROPERTY <br /> <br />WHEREAS, the City of Louisville desires to acquire two parcels of property totaling 12.80 <br />acres, more or less, owned by the Andrew Damyanovich Trust and the Lillian 1. Damyanovich <br />Trust; and <br /> <br />WHEREAS, the property is located in unincorporated Boulder County, in the Northeast <br />One-Quarter of the Southwest One-Quarter of Section 13, Township 1 South, Range 70 West of the <br />6th P.M., adjacent to and north of Dyer Road (Dillon Road extended) at the western terminus of <br />Dyer Road and approximately one-half mile west of the intersection of McCaslin Boulevard and <br />Dyer Road (the "Property"); and <br /> <br />WHEREAS, the City of Louisville desires to acquire the Property for open space and right- <br />of-way purposes, except for a portion of the Property that is approximately 1.5 acres in area and <br />which contains an existing house, barn, and accessory buildings (the "Residential Lot"), which <br />Residential Lot is not being acquired for any park, open space, municipal or governmental purpose, <br />but as a general asset to be sold and disposed of in order to help defray the costs of the open space <br />acquisition; and <br /> <br />WHEREAS, the City of Louisville further desires, upon acquisition of the Property, to sell <br />to the County of Boulder conservation easements in gross over certain portions of the Property; and <br /> <br />WHEREAS, the owners of the Property have stated their desire to sell the Property to <br />Louisville upon the terms and conditions of mutually-agreeable purchase contract; and <br /> <br />WHEREAS, a Purchase Contract to Buy and Sell Real Estate has been proposed with the <br />owners for purchase of the Property; and <br /> <br />WHEREAS, a Purchase Agreement for the Purchase of Conservation Easements has been <br />proposed for the sale to the County of Boulder of conservations easements in gross; and <br /> <br />WHEREAS, the City Council by this Resolution desires to approve the Purchase Contract <br />and Purchase Agreement and authorize their execution. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />1 <br />
