<br />SECTION 5. Section 201(c) of the Uniform Mechanical Code <br />as adopted by Ordinance 46J of the Louisville Municipal Code <br />is hereby repealed. <br /> <br />SECTION 6. The following section is hereby added to <br />the Uniform Mechanical Code as adopted by Chapter 22, Ordinance <br />46J, and the section is hereby added to Chapter 22, Ordinance 46J, <br />of the Louisville Municipal Code: <br /> <br />Section 201(c) <br /> <br />Right of Entry <br /> <br />Whenever necessary to make an inspection to enforce any <br />of the provisions of this Code, or whenever the Building Official <br />or his authorized representative has reasonable cause to believe <br />that there exists in any building or upon any premises, any condition <br />which makes such building or premises unsafe as defined in Section <br />20J of the Building Code, the Building Official or his authorized <br />representative may enter such building or premises at all reasonable <br />times to inspect the same or to perform any duty imposed upon <br />the Building Official by this Code; provided that if such building <br />or premises be occupied, he shall first present proper credentials <br />and demand entry; and if such building or premises be unoccupied <br />he shall first make a reasonable effort to locate the owner or <br />other persons having charge or control of the building or premises <br />and demand entry. If such entry is refused, the Building Official <br />or his authorized representative shall have recourse to every <br />remedy provided by law to secure entry. <br /> <br />"Authorized Representative" shall include the officers <br />named in Section 201(a) and (b) of this Code. <br /> <br />SECTION 7. <br />Municipal Code is <br /> <br />Section 4, Ordinance 46J, of the Louisville <br />hereby repealed. <br /> <br />SECTION 8. The following section is hereby added to <br />Chapter 22, Ordinance 463 of the Louisville Municipal Code: <br /> <br />Section 4 Penalties <br /> <br />It shall be unlawful for any person, firm, or corporation <br />to erect, construct, enlarge, alter, repair, move, improve, remove, <br />convert or demolish, equip, usej occupy, or maintain any building <br />or structure in the city, or cause the same to be done, contrary <br />to or in violation of any provisions of this ordinance. <br /> <br />SECTION 9. Section 1.209 of the Uniform Fire Code as <br />adopted by Ordinance 466 of the Louisville Municipal Code is <br />hereby repealed. <br /> <br />SECTION 10. The following section is hereby added to <br />Chapter 22, Ordinance 466 of the Louisville Municipal Code: <br /> <br />Section 1.209 Right of Entry <br /> <br />Whenever necessary to make an inspection to enforce any of <br />the provisions of this Code, or whenever the Chief or his authorized <br />representative has reasonable cause to believe that there exists <br />in any building or upon any premises, any condition which makes <br />such building or premises unsafe, the Chief or his authorized <br />representative may enter such building or premises at all reasonable <br />times to inspect the same or to perform any duty imposed upon the <br />Chief by this Code; provided that if such building or premises <br />be occupied, he shall first present proper credentials and demand <br />entry; and if such building or premises be unoccupied, he shall <br />first make a reasonable effort to locate the owner or other persons <br />having charge or control of the building or premises and demand <br />entry.
