<br />SECTION 6. SiJbS8ctiorJS (3) through (H), inclusive, of <br />Section J-I02, Chapter 17.40, Title 17 of the Louisville Municipal <br />Code are hereby repealed. <br />SECTION 7. Section J-I02, Chapter 17.40, Title 17 of <br />the Louisville Municipal Code is hereby amended to add the following <br />subsections: <br />(B) Within sixty (60) days of receipt of the application, <br />the Planning Commission shall hold a public hearing to consider the <br />application. Public Notice of said hearing shall be published <br />in a newspaper of general circulation within the City at least <br />fifteen (15) days prior to such hearing. Additionally owners <br />of property within three hundred (JOO) feet of the subject property <br />shall be notified of the public hearing by first class mail. <br />(C) Within thirty (JO) days following the public hearing or <br /> <br />within such time as is mutually agreed by the Planning Commission <br /> <br />and the applicant, the Planning Commission shall either recommend <br /> <br />approval of the application, with or without conditions or denial <br /> <br />of the application to the City Council. <br />(D) Within thirty (JO) days of receipt of the Planning <br />Commission recommendation, the City Council shall approve the <br />application with or without condition, or deny the application. <br />(E) An approved special review use shall not be conducted <br />until the Zoning Administrat~v~has issued a Special Review Use <br />Certificate. Said certificate shall be issued only after the <br /> <br />applicant has entered into an agreement with the City specifing <br /> <br />that all conditions imposed by the City Council will be completed <br /> <br />and that the use and improvements will be in accordance w~th the <br /> <br /> <br />approved application site plan and development schedule. Said <br /> <br /> <br />agreement shall be recorded in the office of the Clerk and Recorder, <br /> <br /> <br />County of Boulder, State of Colorado. <br /> <br />(F) Any person applying to the courts for a review of any <br /> <br />decision made under the terms of this section shall apply for <br /> <br /> <br />review within thirty (JO) days after the date of decision and <br /> <br />shall be required to pay the cost of preparing a transcript of <br /> <br />-4- <br />
