<br />proceedings and the application for review shall be in the nature <br /> <br />of certiorari under Rule 106 (a) (4) of the Colorado Rules of <br />Civil Procedure. <br />SECTION 8. Subsections (B) through (F), inclusive, Section <br />6-112, Chapter 17.28, Title 17 of the Louisville Municipal Code <br />are hereby repealed. <br />SECTION 9. Section 6-112, Chapter 17.28, Title 17 of <br />the Louisville Municipal Code is hereby amended to add the following <br />subsections: <br />(B) Within sixty (60) days after filing the application, <br />the Planning Commission shall notify by mail the owners of abutting <br /> <br />properties and properties located w~thin three hundred (300) feet <br /> <br />of the property lines of the land included in the planned unit <br /> <br /> <br />development, hold a public hearing and approve, disapprove, or <br /> <br /> <br />approve the application with modifications. <br /> <br /> <br />(C) Approval of the application shall constitute approval <br /> <br />of the preliminary development plan and shall be valid for one <br /> <br /> <br />(1) year. A one (1) year extension of approval time may be <br /> <br />applied for in writing to the Planning Commission. <br /> <br />(D) Allor any portion of an approved preliminary development <br /> <br />plan may be submitted for final development plan purposes. In <br /> <br />the case of partial submission, the approval of the remaining <br /> <br />portion of the preliminary development plan shall automatically <br /> <br />gain an extension of one (1) year before another phase of the <br /> <br />plan must be submitted in final form. <br /> <br />(E) No building permits may be issued on land within the <br /> <br />planned unit development until the final development plan has <br /> <br />been approved by the City Council under the procedures provided <br /> <br />in the following sections. <br /> <br />SECTION 10. <br /> <br />Subsections A(58) 3nd A(59), Section IJ-I02, <br /> <br />Chapter 17.08, Title 17, of the Louisville Municipal Code are <br /> <br />hereby repealed. <br /> <br />-5- <br />
