Roll call vote was <br /> taken. The motion carried by a vote of 4-2. Councilors Muckle and Sackett voted no. <br /> Absent: Councilor Yarnell. <br /> ORDINANCE No. 1604, SERIES 2011 — AN ORDINANCE AMENDING CHAPTER <br /> 17.14 OF THE LOUISVILLE MUNICIPAL CODE TO ALLOW GROUND FLOOR <br /> MULTI-UNIT DWELLINGS OR APARTMENTS, CONDOMINIUMS, AND <br /> TOWNHOMES IN THE RESIDENTIAL MIXED USE (MU-R) DISTRICT AS A SPECIAL <br /> REVIEW USE — 2nd Reading — Public Hearing <br /> Mayor Sisk requested a City Attorney introduction. <br /> City Attorney Light read Ordinance No. 1604, Series 2011. <br /> Mayor Sisk opened the public hearing and requested a staff presentation. <br /> Planning Director Russ explained the City Staff, the Louisville Revitalization <br /> Commission, and Louisville Planning Commission are recommending the Louisville City <br /> Council approve amending Chapter 17.14 Mixed Use Zoned District of the Louisville <br /> Municipal Code (LMC). This would allow ground floor multi-dwelling unit apartments, <br /> • condominiums, and townhomes in the Mixed Use Residential District as a Special <br /> Review Use (SRU) to improve the market viability of the Mixed-Use Residential Zone <br /> District within the revitalization area. The request does not alter the allowed residential <br /> densities within the revitalization area. <br /> The purpose of the request is to alleviate potential residential builders of the unrealistic <br /> burden requiring non-residential ground floor uses on multi-dwelling unit apartments, <br /> condominiums, and townhomes internal to the Highway 42 Revitalization Area. Allowing <br /> ground floor multi-dwelling unit apartments, condominiums, and townhomes in the <br /> Mixed-Use Residential Zone District as an SRU will guarantee staff can use the five <br /> SRU Criteria, identified in Section 17.40.100 of the LMC as tools to ensure a high <br /> quality and active pedestrian "Main Street" environment consistent with the Purpose and <br /> Intent of the Mixed Use Development Design Standards and Guidelines. <br /> In 2008, the LRC retained Economic & Planning Systems (EPS) to complete an <br /> independent third party market analysis for the Highway 42 Revitalization Area and to <br /> provide public finance projections for the Urban Renewal Area (URA). The report <br /> identified weaknesses in the Highway 42 Plan's call for vertical mixed use products <br /> internal to the revitalization area. The EPS Study stated mixed use development would <br /> be better suited where it can be oriented toward a single interior node near transit and <br /> along Highway 42 where it would be more accessible to increased traffic flows. These <br /> locations would enhance the viability of retail businesses. <br /> • <br />
