There were no comments. <br /> Mayor Sisk asked City Attorney Light whether the public hearing should be closed. <br /> City Attorney Light stated that was the proper protocol. He explained the public hearing <br /> was conducted this evening and on November 1st, Council would approve resolutions <br /> adopting the 2012 budget, and setting the appropriations and the mil levy. The City <br /> Council is not obligated to have a public hearing on November 1st, but can if they so <br /> choose. <br /> Mayor Sisk suggested a public hearing be held on November 1, 2011 to allow for further <br /> public comment. He proposed the public hearing would begin at 5:00 p.m. on <br /> November 1st <br /> APPROVE THE SH 42 WALKWAY AND RETAINING WALL PROJECT AND <br /> AUTHORIZE STAFF TO AWARD BID PROVIDED THE BID AMOUNT IS <br /> WITHIN BUDGET <br /> Mayor Sisk requested a staff presentation. <br /> City Manager Fleming reported on the proposed SH 42 Walkway project and stated the <br /> • City is still waiting for confirmation from CDOT on the detail of how the sidewalk and <br /> retaining wall will fit within the right-of-way. He explained the City would not award the <br /> bid until confirmation from CDOT is received. He requested the matter be tabled. <br /> Public Works Director Phare explained due to the lateness in the construction season, <br /> the project may be delayed until next spring. He suggested the matter be tabled. A <br /> recommendation of the bid award would be resubmitted at a later time. <br /> MOTION: Mayor Sisk moved to table the approval of the SH 42 Walkway and Retaining <br /> Wall Project indefinitely, seconded by Mayor Pro Tern Marsella. All were in favor. <br /> Absent: Councilor Yarnell. <br /> ORDINANCE No. 1602, SERIES 2011 —AN ORDINANCE AMENDING CERTAIN <br /> PROVISIONS OF CHAPTER 3.18 OF THE LOUISVILLE MUNICIPAL CODE AND <br /> ADOPTING AN UPDATED SCHEDULE OF DEVELOPMENT IMPACT FEES FOR <br /> MUNICIPAL CAPITAL FACILITIES, TRANSPORTATION CAPITAL FACILITIES, <br /> PARKS AND TRAILS CAPITAL FACILITIES AND RECREATION CAPITAL <br /> FACILITIES — 2nd Reading —Public Hearing <br /> Mayor Sisk requested a City Attorney introduction. <br /> City Attorney Light read Ordinance No. 1602, Series 2011 and noted if, approved the <br /> • effective date of the ordinance will be January 2, 2012. <br />
