<br />ORDINANCE NO. 576 <br /> <br />AN ORDINANCE AMENDING TITLE 17 <br />OF THE LOUISVILLE MUNICIPAL CODE <br />ENTITLED "FLOOD PLAIN ZONING" TO <br />CONFORM TO EXISTING NATIONAL <br />FLOOD INSURANCE PROGRAM REGULA- <br />TIONS. <br /> <br />WHEREAS I the National Flood Insurance Program Regulations <br /> <br />have been updated and amended; and <br /> <br />WHEREAS I the Louisville Municipal Code must be updated in <br /> <br />accordance with said amendments to maintain eligibility in the <br /> <br />National Flood Insw"ance Program; <br /> <br />NOW THEREFORE I BE IT ORDAINED BY THE CITY COUN CIL OF <br /> <br />THE CITY OF LOUISVILLE I COLORADO: <br /> <br />SECTION 1. That Section 17.56. a 1 a of the Louisville Municipal <br /> <br />Code is hereby repealed. <br /> <br />SECTION 2. The following Section is hereby added to Title 17 I <br /> <br />Chapter 17.56 of the Louisville Municipal Code: <br /> <br />17.56. a 1 a Definitions <br /> <br />The following definitions shall apply to this chapter: <br /> <br />A. "Appeal" means a request for a review of the building <br />official's interpretation of any provision of this ordi- <br />nance or a request for a variance. <br /> <br />B. "Area of shallow flooding" means a designated Aa or <br />va Zone on the Flood Insurance Rate Map (FIRM). The <br />base flood depths range from one to three feet; a <br />clearly defined channel does not exist; the path of <br />flooding is unpredictable and indeterminate; and I <br />velocity flow may be evident. <br /> <br />C. "Channel" means that area of a watercourse where <br />water normally flows and not that area beyond where <br />a signiHcant vegetation exists. <br /> <br />D. "Development" means any man-made change to improved <br />or unimproved real estate I including but not limited to <br />buildings or other structures I mining I dredging I filling I <br />grading I paving I excavation or drilling operations <br />located within the area of special flood hazard. <br /> <br />E. "Encroachment lines" are limits of obstruction to flood <br />flows. These lines are generally parallel to the stream. <br />The lines are established by assuming that the area land- <br />ward (outside) of the encroachment lines may be ultimately <br />
