<br />SECTION 7. Section 17.16.080 of Title 17 of the Louisville <br /> <br />Municipal Code dealing with exception to building height regulations <br /> <br />is hereby repealed. <br /> <br />SECTION 8. The following section is hereby added to Chapter <br /> <br />17 . 16 of Title 17 of the Louisville Municipal Code: <br /> <br />17.16.090 Exceptions to building height regulations. <br /> <br />The following type of structures or structural parts are not <br /> <br />subject to the building height limitations of this title; chimneys, tanks I <br /> <br />church spires, belfries, domes, monuments, fire and hose towers I <br /> <br />observation towers, transmission towers, flagpoles I commercial radio <br /> <br />and television towers, masts, aerials, cooling towers, elevator shafts, <br /> <br />ranch and farm accessory uses, and other similar projections. <br /> <br />SECTION 9. The following section is hereby added to Chapter 17.16 <br /> <br />of Title 17 of the Lou:lsville Municipal Code: <br /> <br />17 . 16.240 Oil and ga s exploration and production. <br /> <br />Oil and gas exploration and production may be permitted in the <br /> <br />Agricultural District as a use by special review. In addition to meeting <br /> <br />the requirements for special review as specified in Chapter 17.40 I the <br /> <br />application shall include a report stating the impact of the proposed <br /> <br />operation on adjacent properties and development; the proposed measures <br /> <br />to mitigate any adverse impact; and a summary of unavoidable adverse <br /> <br />impact. <br /> <br />A. Said report shall address the following items and other items <br /> <br />as may be required to adequately evaluate the impact of the proposal <br /> <br />operation: <br /> <br />1. Proof of mineral right ownership. <br />2. Schedule of exploratory drilling. <br />3. Provision for drill site, tank battery and pipeline valve security. <br />4. Aural and visual screening provisions of drill site and tank battery. <br />5. Night lighting <br />6 . Flaring. <br />7. Geologic analysis including subsidence potential following <br />production. <br />8. Provisions for access. <br />9. Provision for hauling to and from the tank battery. <br />10. Site maintenance and clean up. <br />11. Reclamation plan. <br />12. Liability and property damage insurance. <br />13. Performance bond. <br />
