<br />ORDINANCE NO. 604 <br /> <br />AN ORDINANCE AMENDING THE SERVICE EXPAN- <br />SION FEE TO APPLY ONLY TO RESIDENTIAL CON- <br />STRUCTION P.~D TO NEW CONSTRUCTION; AND <br />AMENDING THE PARKS AND RECREATION FUND TO <br />APPLY ONLY TO NEW PRIMARY RESIDENTIAL CON- <br />STRUCTION IN AREAS OUTSIDE OF THE URBAN RE- <br />NEWAL AREAS:. <br /> <br />~mEREAS, the City Council has reviewed the existing Expansion <br /> <br />Fee ordinance and the existing Parks and Recreation Fee ordinance <br /> <br />and determined that these ordinances should be updated; and <br /> <br />WHEREAS, it has been determined that these fees should apply <br /> <br />only to new primary residential construction in areas outside of <br /> <br />the previously designated urban renewal area. <br /> <br />NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />SECTION 1. Section 3.16.010 of Title 3 of the Louisville <br /> <br />Municipal Code is hereby repealed. <br /> <br />SECTION 2. The following section is hereby added to chapter <br />3.16 of Title 3 of the Louisville Municipal Code: <br />3.16.010 Definitions. <br /> <br />For purposes of this chapter, the following definitions shall <br /> <br />apply: <br /> <br />A. "Accessory structure" means a structure incidental or sub- <br />ordinate to the main use of the property including, but <br />not limited to, garages, patios, and tool sheds. <br /> <br />B. "Contractor" me.:ms any person, firm, partnership, joint <br />venture, or corporation required to obtain a building per- <br />mit under Title 15, adopting by reference the Uniform <br />Building Code. <br /> <br />C. "Floor area" means the area included within the surround- <br />ing exterior walls of a building or portion thereof, meas- <br />ured from the inside of all exterior walls which is fur- <br />nished for living purposes and does not include garages <br />or unfinished subgrade levels. <br /> <br />D. "Building" means any structure, other than public structures, <br />without reference to use or occupancy for which a build- <br />ing permit is rE~quired by the provisions of this code. <br /> <br />E. "Building official" means the officer charged with the <br />administration and enforcement of the Uniform Building <br />Code, as adopted by the city, of his regularly authorized <br />deputy. <br /> <br />F. "Public structures" means any structure which shall be <br />used by the general population and which is owned by a <br />governmental entity. <br />
