<br />RESOLUTION NO. 31 <br />SERIES 1997 <br /> <br />A RESOLUTION DENYING A PROPOSED REZONING FROM INDUSTRIAL <br />AND COMMERCIAL BUSINESS TO SINGLE FAMILY ESTATE <br />BOULDER COUNTY LAND VENTURE. <br /> <br />WHEREAS, Richmond American Homes of Colorado, Inc., as <br />applicant for owner Boulder County Land Venture, applied for a <br />rezoning of an approximately 153 -acre parcel, located on the <br />eastern edge of the City at the northeast corner of Dillon Road and <br />South 104th Street, from Industrial and Commercial Business to <br />Single Family Estate; and <br /> <br />WHEREAS, Ordinance No. 1260, Series 1997, which would so <br />rezone the property, was considered by Louisville City Council on <br />First Reading on June 17, 1997; and <br /> <br />WHEREAS, a properly noticed public hearing was held on <br />Ordinance No. 1260 during the June 17, 1997, City Council meeting, <br />at which the applicant and several interested persons presented <br />testimony to the City Council; and <br /> <br />WHEREAS, numerous documents were made a part of the record of <br />the public hearing. <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY <br />OF LOUISVILLE, COLORADO: <br /> <br />1. Based on the testimony of the witnesses and the documents <br />made a part of the record of the public hearing, the City Council <br />finds as follows: <br /> <br />a. Louisville Municipal Code s17.44.050 provides that, <br />for the purpose of establishing and maintaining sound, stable and <br />desirable development within the City of Louisville, the rezoning <br />of land "is to be discouraged." Rezonings may only be considered <br />if one of four stated criteria are met. The criteria are set out <br />in Louisville Municipal Code s17.44.050. <br /> <br />b. The applicant did not establish that any of the four <br />stated criteria were met by the proposed rezoning. <br /> <br />c. The applicant urged that one of the criteria has <br />been met, as follows: "the area for which rezoning is requested <br />has changed or is changing to such a degree that it is in the <br />public interest to encourage a redevelopment of the area." <br /> <br />1 <br />
