<br />7.33 Contestants shall have the right to appeal such decisions to <br />any court of competent jurisdiction. <br />7.4 Special Exception Permits <br />7.41 Application for: Any use listed in this Ordinance as requiring <br />a special exception permit may be allowed only upon application to the <br />City Building Official and issuance of a special exception permit by the <br />Zoning Board of Adjustment. <br />7.42 Procedure to be Followed in Passing on Special Exception Per- <br />mits: The Board shall sche~dule a hearing within 30 days of receipt of a <br />special exception permit application if an applicant desires a hearing. At <br />such a hearing, an applicant may be represented by counsel and may submit <br />his own technical evidence. Pursuant to such an application, the Board, <br />or the Building Official, may: <br />(1) Require the applicant to submit, at the time of application, <br />two copies of an aerial photograph, or a plan certified by a registered <br />engineer, competent in open channel hydraulics, which accurately locates <br />the flood plain proposal with respect to the district limits, channel of <br />stream, existing flood plain developments, together with all pertinent in- <br />formation such as the nature of the proposal; legal description of the <br />property; fill limits and elevations; building floor elevations; and flood <br />proofing measures. <br />(2) Require the applicant to furnish such of the following additional <br />information as is deemed necessary by the Board for the evaluation of the <br />effects of the proposal upon flood flows and flood plain storage and to <br />render a decision on the proposed flood plain use. <br />(a) A typical valley cross-section showing the channel of the <br />stream, the flood plain adjoining each side of channel, cross-sectional <br />area to be occupied by the proposed development, and high water information. <br /> <br />-11- <br />
