<br />2.6 Warning and Disclaimer of Liability: The degree of flood pro- <br />tection intended to be provided by this section is considered reasonable <br />for regulatory purposes and is based on engineering and scientific methods <br />of study. Larger floods may occur on occas ions or the fl ood hei ght may be <br />increased by man-made or natural causes, such as ice jams and bridge openings <br />restricted by debris. This ordinance does not imply the areas outside flood <br />plain area boundaries or land uses permitted within such areas will always <br />be totally free from flooding or flood damages. Nor shall this section <br />create a liability on the part of or a cause of action against the city or <br />any officer or employee thlereof for any flood damages that may result from <br />reliance on this ordinance. <br />2.7 Adoption of Official Maps: The location and boundaries of the <br />Flood Areas established by this ordinance are shown upon the "Flood Plain <br />Zoning ~.1ap of the City of Louisville, which are hereby incorporated into <br />this ordinance and which map was prepared by U. S. Department of Agricul- <br />ture Soil Conservation Service as part of a type 15-Flood Insurance Study <br />of the City of Louisville, entitled, Flood Zone Map, as drawn on December <br />12, 1972. Said zoning map, together with everything shown thereon and all <br />amendments thereto, shall be as much a part of this ordinance as if fully <br />set forth and described herein. Each change in the official map shall be <br />subject to the amendment procedure as required in Section 7.3, Mapping Dis- <br />putes. For the purpose of final determination of the flood plain limits, <br />the flood profile shall control. A copy of the flood profile shall be on <br />file with the City Clerk and the City Engineer. <br />SECTION 3. NONCONFORMING USES WITHIN FLOOD PLAINS. <br />3.1 The existing lawful use of a structure or premises which is not <br />in conformity with the provisions of this ordinance may be continued sub- <br />ject to the following conditions: <br />3.11 No such use shall be expanded or enlarged except in conformity <br />with the provisions of this ordinance. <br />3.12 Substantial improvement, as herein defined, to any nonconform- <br />ing structure or use must result in the permanent change of the structure <br />or use to a conforming use. <br /> <br />-5- <br />
