<br />SECTION 6. REVOCATION OF LICENSE BY TREASURER. <br /> <br />The Treasurer may on a reasonable notice and after full hearing, <br /> <br />revoke the license of any person found by the Treasurer to have violated <br /> <br />any provisions of this Ordinance. <br /> <br />SECTION 7. APPEAL FROM LICENSE REVOCATION. <br /> <br />Any finding and order of the Treasurer revoking the license of any per- <br /> <br />son shall be subject to review by the District Court of the Twentieth Judicial <br /> <br />District of the State of Colorado, upon application of the aggrieved party. <br /> <br /> <br />The procedure for review shall be in accordance with Rule 106 (a)(4) of the <br /> <br /> <br />Colorado Rules of Civil Procedure. <br /> <br /> <br />SECTION 8. WHEN LICENSE NOT REQUIRED. <br /> <br /> <br />No license shall be required for any person engaged exclusively in the <br /> <br />business of selling commodities which are exempt from taxation. <br /> <br />SECTION 9. TAXABLE GROSS RECEIPTS ITEMS. <br /> <br />On and after January 1, 1967, there is hereby levied and there shall <br /> <br />be paid a tax in the amount stated in Section 11 hereof, as follows: <br /> <br />9-1. Upon the gross proceeds of the purchase price received or charged <br /> <br />upon all sales and purchases of tangible personal property at retail. <br /> <br />9-2. Upon the gross proceeds from any amount received for all meals or <br /> <br />food, and cover charge, if any, furnished in or from any restaurant, eating <br /> <br />house, hotel, drug store, club, resort, stand or vehicle or other such place <br /> <br />at which meals or foods are regularly sold to the public. <br /> <br />9-3. Upon the gross proceeds of sales of alcoholic beverages whether <br /> <br />sold for consumption on the premises or off the premises of the retailer. <br /> <br />9-4. Upon the gross proceeds from steam or other heating service fur- <br /> <br />nished and sold for domestic or commercial use. <br /> <br />- 6 - <br />
