Section 2: -Grant: of License- Subject to the terms and conditions hereinafter contained, MOtmtain States Video, is hereby granted the right and license to install, operate and maintain a cable television system ,dthin the boundaries of the City of Louisville, as the same presently exist, or as they may hereafter be altered, which license shall .)e effective from the effective date of this ordinance for a period of 20 years thereafter, unless sooner revoked in accordance with the terms thereof. Section 3: -Use of Streets and Alleys- The license herein granted $,1all include the right to make use of the streets and alleys within th\;O City of Louisville for thl~ erection, installation, repair, removal and r~- placement of all lines, cables, transmitters and other equipment necessary to the operation and maintenance of such a system, provided, however, that said use shall be subject to the following conditions: (a) All cables, lines and other equipment to be utilized by Mountain States Video in the operation of its CATV system within the City of Louisville shall be owned by it and Mo~~tain States Video, shall not mill~e use of any equipment owned by any other person, partnership, utility or corporation, save and except to the extent that this ordinance specifically grants Mountain States Video, the right and authority to do so, without the express, written consent, evidenced by a duly adopted resolution, of the City Council of the City of Louisville. (b) No such equipment shall be erected or installed upon, in, under, through or over any street or alley of the City unless and until the Director of Public Works gives written approval of the location thereof. (c) In any street or alley in which there presently exists utility poles, or other facilities, capable of having the cable television system's cable, lines and equipment attached thereto, Mountain States Video may either place the same underground in such street or alley in such location, at such depths and in such manner as may be approved by the City Manager or his designated agent or attempt to obtain the written consent of the owner of such poles or other facilities to the attachment thereto of the cable television system's cables, lines and equip- ment upon such financial terms as may be mutually agreed upon betwelan Mountain States Video and said owner. -2-
