Cd) In the event that the owner's consent cannot be obtained, and in any street or alley within which there does not exist adequate poles or other facilities for attaching the system's equipment, all cables, lines and other equipment to be placed in such street or alley, shall be placed underground in such street or alley in such location, at such depths, and in such mannerl. as may be approved by the City Manager or his designated agent. ~ Ce) All equipment placed upon, in, through, under or over any street or alley shall be installed, erected and maintained so that the same shall not obstruct, or interfen~ with, any other lawful use of the same and shall bl~ subject to the approval, as to location, by the City Manager or his designated agent. (f) The City of Louisville by its City Council, City Manager, or other designated agent, at their sole dis- cretion, may require Mountain States Video to post a reasonabl1e performance bond with the City Clerk prior to the company using any of the streets and alleys of the City to guarantee that the streets and alleys will be repaired to their former condition. Section 4: - License Non-Exclusive, Non-Transferrable and Revocable- (a) The license herein granted, and all rights, privileges and permits issued hereunder, or appurtenant to said license, shall be non-exclusive, it being understood that the City of Louisville may at any time grant one or more add.itional licenses of the same or similar nature. (b) The license, herein granted, and all such privileges and permits, shall be considered to be a personal license of Mountain St:ates Video and shall not be transferred or assigned wi.thout the express, written consent of the City Council of the City of Louisville, evidenced by a duly adoptE!d ordinance authorizing such transfer. (c) There is hereby reserved the right to repeal this ordi- nance and 1:0 revoke the license, privileges and permits herein granted at any time, with or without cause; pro- vided, however, that such repeal or revocation shall not be effective except through the adoption of an ordinance effectuating the repeal or revocation, prior to the adoption o:E which Mountain States Video shall be given an opportwlity to appear before Council and show cause why the same should not be repealed or revoked; pro- vided, further, that Council's determination to repeal this ordinance, or to revoke the license, privileges and permit herein granted shall be held to be a legis- lative decision and shall not be reviewable by any Court, eit'her in law or in equity. -3-
