<br />will cause excessive police, fire, utility, and street cost shall not <br />be accepted. <br /> <br />(d) Zoning of the area to be annexed shall be reasonable in terms of <br />existing city zoning classifications and shall be considered by the <br />city planning commission; <br /> <br />(e) The area shall be located "where water and sewer utility services <br />are possible without undue expense to be City. Where exceptional costs <br />may be required in serving the area proposed for annexation, financial <br />arrangements to extend water or sewer mains shall be agreed upon prior <br />to annexation. <br /> <br />(f) Problems of storm drainage shall be considered prior to annexation <br />in order to be sure that flooding problems within and adjoining the <br />area to be annexed will not be increased by development of the tract; <br /> <br />(g) Water rights accompanying the land to be annexed shall be deeded <br />to the city whenever such transfer is possible; <br /> <br />(h) The city attorney shall report on the apparent legal adequacy <br />of the annexation petition and the procedures followed in each case <br />by the city. <br /> <br />18.4 City Council Action. The City Council after receiving all necessary <br />recommendations shall follow the procedure required by the State of Colorado <br />enabling statutes to include the following: <br /> <br />(a) The petition shall be considered to determine if it meets the <br />requirements of the law. <br /> <br />(b) If the petition "is signed by the Owners of 100 percent of the <br />landowners, the Council may annex the territory by ordinance without <br />notice or hearing and, further, without election unless additional terms <br />and conditions are to be imposed. <br /> <br />(c) If less than 100 percent of the landmwners are signers of the <br />annexation petition or at the discretion of the Council, the City <br />Council must: <br />Establish the date, time and place of a public hearing within <br />30 to 60 days to determine whether or not Sections 3 and 4 of the <br />Municipal Annexation Act of 1965 have been complied with; <br /> <br />(d) Cause Notice to be published once a week for four weeks in some <br />newspaper having general circulation in the area. The first publication <br />of such notice must be at least 30 days prior to the date of the hearing. <br /> <br />18.5 "Outside" Water Policy. As a means of encouraging annexation of <br />lands surrounding the City of Louisville, no water.taps shall be permitted <br />outside the City limits except under the following conditions: <br /> <br />(a) That property served does not join existing Louisville City Limits; <br /> <br />(b) That owners of the property to be served agree to annex to the <br />City of Louisville when their property is contiguous to the City Limits; <br /> <br />-2- <br />
