<br />(Jl) Right-of-Way, Public. AI I streets, roadways, sidewalks, alleys, and <br />al I other areas reserved for present or future use by the public, as a matter <br />of right, for the purpose of vehicular or pedestrian travel. <br /> <br />(Kl) Street. The entire width between the boundary lines of every way which <br />provides for public use for the purpose of vehicular and pedestrian traffic <br />and placement of util ities and including the terms "road," "highway," "land," <br />"place," "avenue," "alley," or other simi lar designations. <br /> <br />(ll) Street Tree. A tree located in public rights-of-way of streets. <br /> <br />(Ml) Subdivider (or Developer). Any person, partnership, joint venture, <br />assoc:iation, corporation, person in a representative capacity, or other <br />legal entity or legal representative who shal I participate in any manner in <br />the dividing of land for the purpose, whether immediate or future, of sale <br />or bui Iding development. <br /> <br />(Nl) Subdivision. The division of a lot, tract or parcel of land into two <br />or more lots, plats, sites, or other divisions of land for the purpose, <br />whether immediate or future, of sale or building development, whether resi- <br />dential, industrial, office, business, or other use. The term shal I also <br />include and refer to any division of land previously subdivided or platted <br />but shal I not include nor refer to a transaction or transactions which is <br />or ar'e exempt under the provisions of Section 1-104. <br /> <br />(01) Usable Open Space. land which is free of bui Idings, structures and <br />other substantial improvements including outdoor recreation areas, driveways <br />that do not serve three or more parking spaces and underground facilities, <br />but excluding public or private rights-of-way for streets or highways, roofs, <br />open parking areas, parking garages, and slopes in excess of twenty-five (25) <br />per cent. <br /> <br />7-4 <br />
