<br />ORDINANCE NO. 425 <br /> <br />AN ORDINANCE ENACTING A DOCUMENTARY FEE UPON THE <br />RECORDING OF DOCUMENTS OF TITLE CONVEYING REAL <br />PROPERTY IN THE CITY OF LOUISVILLE, PROVIDING <br />FOR THE IMPOSITION AND COLLECTION OF THE SAME <br />AND ESTABLISHING CERTAIN EXCEPTIONS. <br /> <br />WHEREAS, the City Council of the City of Louisville, Colorado, <br />deems it necessary and appr'opriate to enact a City Documentary Fee upon <br />any deed or instrument in \'lriting, wherein or whereby title to real <br />property situated in this City is granted or conveyed. <br /> <br />NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF <br />LOUISVILLE, COLORADO: <br /> <br />Section 1. Definitions: <br /> <br />(a) Person. "Personll means and includes any individual, firm, <br />copartnership, Joint venture, association, fraternal organization, cor- <br />poration, estate, trust, trustee in bankruptcy, executor, administrator, <br />syndicate, the United States, this State, any county, city and county, <br />municipality, district or other political subdivision of the State, or <br />any group or combination acting as a unit. <br /> <br />(b) Document. "Document" means and includes any deed, contract <br />of sale, instrument or writing by which real property located in the City <br />of Louisville is transferred. "Documentll shall not mean or include any <br />decree of distribution in probate proceedings, any document terminating <br />or evidencing termination of a Joint tenancy in real property except where <br />an additional consideration of value is paid in connection with such <br />termination, or a decree of agreement partitioning real property held <br />under common ownership unless a consideration of value is paid in connection <br />therewith. <br /> <br />(c) Transfer. "Transfer" means and includes any conveyance <br />of the ownership of or titll~ to real property and is evident by any <br />person offering for recording in the office of the County Clerk and <br />Recorder in the County of Bnulder, Colorado, any deed or instrument in <br />writing wherein or whereby title to real property situated in this <br />City is granted or conveyed, subject to the exclusions provided in this <br />Ordinance. Transfer shall not mean or include the transfer of title to <br />a trustee solely as securi t~1 for an obl igation, the change of interest in <br />real property by reason of death, will or decree of distribution, nor <br />any increase in an estate in real property be reason of termination of <br />Joint tenancy or by partition of property unless a consideration of value <br />be paid in connection with such joint tenancy termination or such partition. <br /> <br />(d) Real Property. "Real Property" means and includes all <br />lands or interests in lands within the City to which title or the right <br />of title has been acquired from or ratified by the government of the <br />United States or the State of Colorado; all mines, minerals and quaries <br />in and under the land and all rights and privileges appertaining thereto, <br />and improvements. <br />
