Lipton moved the consent <br /> agenda be approved. Carlson seconded. Machado - yes, Lipton -yes, Rommelfanger <br /> - yes, Carlson - yes and Gunning - yes. Consent agenda approved. <br /> Authority Business <br /> A. Show Cause Hearing - Richard N. Hand, LLC d/b/a Ralphie's Sports Tavern <br /> - 585 E. South Boulder Road -2/10/11 Incident <br /> Chairperson Gunning opened the show cause hearing and asked the attorneys for the <br /> City and for the licensee to introduce themselves and report if they were ready to <br /> proceed. Kristin Brown, Special Prosecutor introduced herself and Adam Stapen, <br /> Attorney for the licensee introduced himself to the Authority. Mr. Stapen reported a <br /> stipulation had been reached. <br /> Ms. Brown outlined the stipulation. It stipulated a guilty plea to one violation concerning <br /> serving to a visibly intoxicated person, serving a 7 day suspension with 4 days held in <br /> abeyance, training for employees and the opportunity to pay a fine-in-lieu. <br /> Mr. Stapen stated the licensee desire to know if the Authority would be amenable to <br /> allowing the fine-in-lieu instead of prohibiting alcohol service for the days. He stated <br /> this would make a big difference to his client whether they would give up their right to <br /> • present testimony. <br /> The Authority discussion centered on whether it was appropriate to group the <br /> stipulations for all the show cause hearings or indicate at this time if a fine in lieu would <br />
