Ms. Brown provided her reasoning for offering to dismiss the third violation. She assessed the strength of the cases and felt the third violation was the weakest one before the Authority. She considered the goal and felt it was more important to provide the licensee with consequences, but wanted to be reasonable and provide awareness to the licensee. Sergeant Lanphere added the licensee was working hard to be pro-active and do what needed to be done to be a successful business. They had many of their employees attend a special training provided by the police department. Rommelfanger moved to accept the stipulation and the findings and order drafted by the Special Prosecutor and set the days to serve the suspension as July 2, 3 and 4, 2011. Machado seconded. Roll Call Vote: Gunning — yes, Carlson — no, Lipton — yes, Rommelfanger— yes and Machado — yes. B. Show Cause Hearing — Richard N. Hand, LLC d/b/a Ralphie's Sports Tavern — 585 E. South Boulder Road -2/12/11 Incident Chairperson Gunning introduced the show cause hearing on this matter and asked for a motion from the Authority. • Lipton moved the Authority approve the stipulation and proposed findings and order and set the days of suspension as July 5 — 11, 2011. Roll Call Vote: Gunning — yes, Carlson — yes, Lipton — yes, Rommelfanger- yes and Machado — yes. C. Show Cause Hearing — Richard N. Hand, LLC d/b/a Ralphie's Sports Tavern — 585 E. South Boulder Road — 2/27/11 Incident Chairperson Gunning asked for a motion on the proposed stipulation and findings and order for dismissal on this matter. Rommelfanger moved to accept the stipulation and findings and order for dismissal. Machado seconded. Roll Call Vote: Machado — yes, Rommelfanger— yes, Lipton — yes, Carlson — yes and Gunning — yes. Attorney Stapen explained the incidents to the Authority and stressed the licensee was taking responsibility and working hard to train employees. Policies and procedures are now in place to prevent incidents in the future. D. Public Hearing — Medical Marijuana Center Application —Altermeds, LLC d/b/a Altermeds — 1156 W. Dillon Rd. #3 Gunning opened the public hearing on the new license application. Secretary Hanson • stated the application was complete and included in the Authority packet. Background checks revealed no criminal history on the owner and the hearing had been posted and published in accordance with state law.
