Local Licensing Authority <br /> Minutes <br /> May 23, 2011 <br /> Page 3 of 7 <br /> be granted. There was discussion on calculating the fine in lieu and the days of <br /> suspension. Ms. Brown provided her reasoning for offering to dismiss the third <br /> violation. She assessed the strength of the cases and felt the third violation was the <br /> weakest one before the Authority. She considered the goal and felt it was more <br /> important to provide the licensee with consequences, but wanted to be reasonable and <br /> provide awareness to the licensee. <br /> Sergeant Lanphere added the licensee was working hard to be pro-active and do what <br /> needed to be done to be a successful business. They had many of their employees <br /> attend a special training provided by the police department. <br /> Rommelfanger moved to accept the stipulation and the findings and order drafted by the <br /> Special Prosecutor and set the days to serve the suspension as July 2, 3 and 4, 2011. <br /> Machado seconded. Roll Call Vote: Gunning — yes, Carlson — no, Lipton — yes, <br /> Rommelfanger— yes and Machado — yes. <br /> B. Show Cause Hearing — Richard N. Hand, LLC d/b/a Ralphie's Sports Tavern <br /> — 585 E. South Boulder Road -2/12/11 Incident <br /> Chairperson Gunning introduced the show cause hearing on this matter and asked for a <br /> motion from the Authority. <br /> • Lipton moved the Authority approve the stipulation and proposed findings and order and <br /> set the days of suspension as July 5 — 11, 2011. Roll Call Vote: Gunning — yes, <br /> Carlson — yes, Lipton — yes, Rommelfanger- yes and Machado — yes. <br /> C. Show Cause Hearing — Richard N. Hand, LLC d/b/a Ralphie's Sports Tavern <br /> — 585 E. South Boulder Road — 2/27/11 Incident <br /> Chairperson Gunning asked for a motion on the proposed stipulation and findings and <br /> order for dismissal on this matter. <br /> Rommelfanger moved to accept the stipulation and findings and order for dismissal. <br /> Machado seconded. Roll Call Vote: Machado — yes, Rommelfanger— yes, Lipton — <br /> yes, Carlson — yes and Gunning — yes. <br /> Attorney Stapen explained the incidents to the Authority and stressed the licensee was <br /> taking responsibility and working hard to train employees. Policies and procedures are <br /> now in place to prevent incidents in the future. <br /> D. Public Hearing — Medical Marijuana Center Application —Altermeds, LLC <br /> d/b/a Altermeds — 1156 W. Dillon Rd. #3 <br /> Gunning opened the public hearing on the new license application. Secretary Hanson <br /> • stated the application was complete and included in the Authority packet. Background <br /> checks revealed no criminal history on the owner and the hearing had been posted and <br /> published in accordance with state law. <br />
