Local Licensing Authority <br /> Minutes <br /> June 27, 2011 <br /> Page 3of5 <br /> • information regarding the books and records of the licensee are sufficient to determine <br /> the amount and the licensee has not had the license suspended, revoked or stayed <br /> during the two-year period immediately preceding the consideration of this petition. <br /> Based on these findings Rommelfanger moved the Authority accept the petition to <br /> accept payment of a fine-in-lieu of$3,617.28 and if paid the suspension would be <br /> stayed. Machado seconded. Roll Call Vote: Machado — yes, Rommelfanger— yes and <br /> Gunning — yes. Petition to pay fine in lieu approved. <br /> B. Modification of Premises — Clover Clan, LLC d/b/a Old Louisville Inn — Hotel <br /> and Restaurant Liquor License — 740 Front Street <br /> Rommelfanger noted the City Manager had signed the licensing agreement for use of <br /> the tables on this sidewalk area. <br /> Gunning moved the Authority approve the application for modification of premises as <br /> set forth on Exhibit A of the revocable license agreement between the City and the <br /> licensee be granted and be in place as long as the licensing agreement is in place. <br /> Rommelfanger seconded. All in favor. Modification of premises approved. <br /> C. Special Events Permit Application —American Legion Post 111 — Steinbaugh <br /> Pavilion — September 16, 2011 <br /> • Chairperson Gunning introduced the item and Rommelfanger disclosed he is a member <br /> of the Legion but felt it would not affect his vote in any manner. <br /> Questions were raised about whether or not the applicant had contacted the police <br /> department for support for this event. Officer Redard stated at the time of day for this <br /> event, there would be officers on duty and he could make the department aware of the <br /> event. Authority members asked the applicant to contact Sergeant Lanphere. <br /> Machado moved the Authority approve the special events permit for the American <br /> Legion Post 111 for September 16, 2011. Rommelfanger seconded. <br /> D. Special Events Permit Application —Variety Arts of Louisville d/b/a The Art <br /> Underground — 917 S. Front Street— July 7, 2011 <br /> Gunning noted this was a smaller event than the previous item. He was concerned <br /> about the security at this event. There was discussion concerning who was providing <br /> the alcohol due to an incomplete question on the City questionnaire. This led to <br /> questions about requiring guidance in the future. <br /> Gunning moved the Authority approve the special events application for the Art <br /> Underground for the July 7 event. Rommelfanger seconded. Roll Call Vote: Machado <br /> — yes, Rommelfanger— yes and Gunning — yes. Application approved. <br /> • E. Tastings Application — Retail Liquor Store License — Down Under, LLC <br /> d/b/a Down Under Liquor— 1140 Pine St. #1 <br />
