Local Licensing Authority <br /> Minutes <br /> July 25, 2011 <br /> Page 3 of 4 <br /> • Chairperson Gunning noted this item was in response to Senate Bill 11-066 passed by <br /> the state legislature in 2011. It would increase the number of days a non-profit could <br /> hold special events and would eliminate the necessity for state approval. The local <br /> authority would check the state database for number of days the sponsoring <br /> organization had already used for special events as well as reporting events held in <br /> their licensing area. <br /> Attorney Culley stated if this ordinance was approved by the Authority, it would be <br /> forwarded to Council for their approval. The Authority could then adopt a resolution <br /> which would change approval for all special events permits only at the local level. <br /> Discussion by the Authority centered on security for special events. Sergeant Lanphere <br /> felt it was a case by case review. Authority members talked about this ordinance giving <br /> them better ability to schedule hearings if they needed. Questions were asked about <br /> compelling applicants to attend a meeting where their application is considered. <br /> Attorney Culley cautioned the Authority against codifying any action to make applicants <br /> attend or risk denial. Members wanted the Secretary to draft a letter to have new <br /> applicants for special events attend the meeting when their application is being <br /> considered to respond to questions. There was also a suggestion the issues of security <br /> and attendance at the meeting be added to the seller/server training sessions. <br /> Rommelfanger moved the Authority approve the draft ordinance and forward it to City <br /> • Council for their review and approval. Carlson seconded. Roll Call Vote: Lipton — yes, <br /> Rommelfanger— yes, Carlson — yes, Wilson - yes and Gunning — yes. <br /> Police Department Reports <br /> A. Incident Report —Waterloo — 6/25/11 <br /> This incident involved a police stop for possible driving under the influence. Wilson <br /> asked Sergeant Lanphere why there was no follow up on this incident and he explained <br /> it was the totality of the circumstances. The Authority members decided there was no <br /> further action to be taken on this matter. <br /> B. Incident Report— Ralphie's — 6/27/11 <br /> This involved follow up on an incident in the parking lot adjacent to the business on the <br /> previous night. Attorney Culley gave the Authority some background on City Code and <br /> how it speaks to incidents in the parking lot. She cautioned since the parking lot is not <br /> considered part of their licensed premise, it may be hard to prosecute. Authority <br /> members discussed the fact it was unfortunate to see this establishment in front of them <br /> again, but each incident had to be taken individually and this one did not require further <br /> action. Sergeant Lanphere said he did feel the establishment is working to do what is <br /> right. <br /> Incident Report—Waterloo — 7/15/11 <br /> S C. <br /> This incident involved a disturbance on the street side patios. Lipton asked for <br /> clarification on whether it was patrons of the establishment. Sergeant Lanphere stated <br /> they were; it was after the Street Faire, lots of folks around and jockeying for space on <br />
