<br />Board of Adjustment <br />Meeting Minutes <br />July 18, 2007 <br />Page 3 of 5 <br /> <br />. <br /> <br />The City of Louisville flood protection elevation for residential construction is <br />two feet above the BFE, or at 5,332 feet. <br />The permit may be granted only if the board finds that all of the criteria as <br />established under Title 17.56.160 A-F have been satisfied, insofar as <br />applicable. <br />Staff finds that all the criteria have been met. <br /> <br />. <br /> <br />. <br /> <br />Staff recommends approval of the Floodplain Development Permit under review to allow <br />for the development of a 14 unit townhome development, with the following condition: <br />1. The applicant must complete FEMA Elevation Certificate (EC) and an <br />approved copy shall be forwarded to the Planning Department upon <br />completion of the work approved by the Board of Adjustment. <br /> <br />Questions of Staff bv the Board and Applicant: <br />Stewart requested clarification from staff regarding how the area is affected by the <br />floodplain and what will change. <br /> <br />Malmquist clarified that the request is for a 2-foot ponding relief. <br /> <br />McCartney stated that Alan Taylor would be best to answer that question. <br /> <br />Loeblich asked what would be the consequences of not approving what is the <br />recommendation of staff. <br /> <br />McCartney stated that if the board approves something other than what is <br />recommended then the applicant has to work to have the elevation certificate match the <br />BOA approval. <br /> <br />Applicant Presentation: <br />Alan Taylor, representing the applicant, briefly discussed the questions asked by the <br />board. <br /> <br />Garrett Mundelein, property owner reviewed the proposed development plan and why <br />the floodplain development permit is required prior to further development. He noted <br />that the properties to the west and south are not in the floodplain. He also noted that the <br />depression in the center of the properties is planned to be used as a local detention <br />pond for the development. <br /> <br />Questions of Applicant bv Board and Staff: <br />Weise asked Mundelein for a history of his ownership of the property. <br /> <br />Mundelein stated the following: 555 County Road ownership in 2000; 557 County Road <br />ownership in 2006 and 561 County Road ownership in February 2007. <br /> <br />Weise asked if he was aware of the conditions. <br /> <br />Mundelein stated he had no problem with the conditions. <br /> <br />Malmquist requested information about the status of occupancy of the trailer homes. <br /> <br />Mundelein stated he has title to the homes and the last of the tenants will be moving out <br />in a few weeks. <br />
