Louisville City Council Meeting <br />April 4, 2000 <br />Page 17. <br /> <br />Sisk voiced his concern over Council approving the lots and with the Peak to Peak <br />School circumventing the planning and permit processes. He stated his concern was that <br />by approving this proposal, Council would be approving the school, after which the <br />City's only recourse would be a court action. <br /> <br />Brown asked Light, if the school went forward on their intent without any discussion or <br />review use, and the City take a negative position, would this ultimately require court <br />action. <br /> <br />Light stated that Council approval on the PUD Development Plan is not subject to the <br />usage. He noted that a school within an industrial area would require a Special Review <br />Use. <br /> <br />MOTION: Davidson moved that Resolution No. 23, Final PUD CTC 1st Filing be tabled <br />to the July 18, 2000 City Council meeting, second Sisk. <br /> <br />Brown stated his concern that by tabling the issue, Council then makes a decision to <br />delay the plans of the school. However, the issue of a school being in a place that may <br />not be appropriate, and the State imposing the issue, caused Brown concern. He stated <br />that he would prefer to openly deal with the challenges and concerns that this particular <br />use creates. <br /> <br />Davidson moved to amend the motion that this item could be moved forward from July <br />18, 2000, if Council so desired. <br /> <br />Light added to an earlier meeting upon establishment of proper public notice. <br /> <br />The amendment was acceptable to the second. <br /> <br />Roll call vote was taken.
