Posted in the required locations and mailed to the surrounding property owners on April 20, 2007. This was a continued agenda item so it was reposted at the required locations on May 25,2007 for the June 14th meeting. Staff Report of Facts and Issues: Wood presented the following summary of the alley vacation request. . A request for an alley right-of-way vacation of 10-feet wide by approximately 125- feet of an undeveloped alley between the south end of Lot 1-5 and the north side of Lot 6, Block 1, Jefferson Place. . Property addresses affected by the vacation are 624 and 628 Lafarge. Lots 4 & 5 are associated with 628 Lafarge; Lots 1-3 are a City of Louisville parking lot; and Lot 6 is associated with 624 Lafarge. . The applicant's position is that the City has already released its interest in the ROW as it has never been improved and no one relies on it for access to property. . The applicant performed a utility locate and found an existing sanitary sewer line for 628 Lafarge that runs on the center line of the alley. . Public Works Department will require 10' utility easement placed over the vacated alley so the private sanitary sewer line can be maintained. The property owner of 628 Lafarge will need to deed an easement from the owner of 624 Lafarge as well as the City of Louisville. . Staff recommends approval of the ROW vacation with one condition: A City standard public utility easement shall be reserved in place of the vacated alley ROW. Easements are hereby reserved under, over, through and across the alley ROW for the operation, maintenance, repair and replacement of existing utilities. Further, easement for existing public utilities, if any shall not be altered or amended by virtue of this ordinance. Dalton moved and Loo seconded a motion to approve Resolution 10, Series 2007 with one condition as presented by staff.
