<br />Planning Commission <br />Meeting Minutes <br />JUNE 14, 2007 <br />Page 2 of 13 <br /> <br />Conflict ofInterest and Disclosure: <br />None heard. <br /> <br />Public Notice Verification: <br />Published in the Daily Camera on April 22, 2007. Posted in the required locations and mailed to <br />the surrounding property owners on April 20, 2007. This was a continued agenda item so it was <br />reposted at the required locations on May 25,2007 for the June 14th meeting. <br /> <br />Staff Report of Facts and Issues: <br />Wood presented the following summary of the alley vacation request. <br />. A request for an alley right-of-way vacation of 10-feet wide by approximately 125- <br />feet of an undeveloped alley between the south end of Lot 1-5 and the north side of <br />Lot 6, Block 1, Jefferson Place. <br />. Property addresses affected by the vacation are 624 and 628 Lafarge. Lots 4 & 5 are <br />associated with 628 Lafarge; Lots 1-3 are a City of Louisville parking lot; and Lot 6 <br />is associated with 624 Lafarge. <br />. The applicant's position is that the City has already released its interest in the ROW <br />as it has never been improved and no one relies on it for access to property. <br />. The applicant performed a utility locate and found an existing sanitary sewer line for <br />628 Lafarge that runs on the center line of the alley. <br />. Public Works Department will require 10' utility easement placed over the vacated <br />alley so the private sanitary sewer line can be maintained. The property owner of 628 <br />Lafarge will need to deed an easement from the owner of 624 Lafarge as well as the <br />City of Louisville. <br />. Staff recommends approval of the ROW vacation with one condition: A City standard <br />public utility easement shall be reserved in place of the vacated alley ROW. <br />Easements are hereby reserved under, over, through and across the alley ROW for the <br />operation, maintenance, repair and replacement of existing utilities. Further, easement <br />for existing public utilities, if any shall not be altered or amended by virtue of this <br />ordinance. <br /> <br />Commission Questions: <br />Loo, Dalton and McA vinew discussed the wording of the condition with staff. <br /> <br />Applicant Presentation: <br />No additional comments. <br /> <br />Members of the Public: <br />None heard. <br /> <br />Staff Summary and Recommendation: <br />No additional comments. <br /> <br />Commission Questions: <br />No additional discussion with staff or applicant. <br /> <br />Public Hearing Closed Commission Comments: <br />All commissioners indicated support of the request. <br /> <br />Dalton moved and Loo seconded a motion to approve Resolution 10, Series 2007 with one <br />condition as presented by staff. <br />
